MOTION TO APPROVE AMENDMENT ONE TO THE COMMUNITY DEVELOPMENT BLOCK GRANT MITIGATION PROGRAM SUBRECIPIENT AGREEMENT BETWEEN THE STATE OF FLORIDA DEPARTMENT OF COMMERCE AND THE CITY OF PEMBROKE PINES FOR THE DESIGN AND CONSTRUCTION OF TWO GENERATORS AT THE WASTEWATER TREATMENT PLANT.

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1.  On June 29, 2020, the Utility Department submitted an application to the Department of Commerce (Commerce, formerly known as the Department of Economic Opportunity) for the Rebuild Florida Critical Hardening Program to receive CDGB-MIT funds for design and construction of two emergency generators at the City’s Wastewater Treatment Plant.

 

2.  The Rebuild Florida Critical Hardening Program and funding from CDGB-MIT assists in mitigation efforts to harden critical facilities and infrastructure against power outages cause by natural or man-made disasters.

 

3.  The current east & west generators located at the City’s Wastewater Treatment Plant (WWTP) are old and nearing the end of their useful lives, and replacement of these generators qualified for funding under the Critical Facility Hardening Program.

 

4.  Funding for this program is allocated through the U.S. Department of Housing and Urban Development’s (HUD) Community Development Block Grant - Mitigation (CDBG-MIT) program formed in response to the 2016 to 2017 presidentially declared disasters.

 

5.  On February 4, 2021, the Utilities Division received a letter from Commerce stating that the City was awarded a grant for $2 million for the design and construction of the two replacement generators, with the associated electrical components.

 

6.  On April 6, 2022, the City Commission approved acceptance of the grant and the associated grant agreement, which was signed by then-Mayor Ortis on April 11, 2022.

 

7.  The current status of the project and grant is that Utilities Department Staff has negotiated a draft agreement with an electrical engineer for design of the project, and that draft is being reviewed by Commerce.  Once approved, the agreement will be presented to the Commission for consideration.  The City has not yet incurred expenses associated with this project and no grant disbursements have been requested to date.

 

8.  On March 6, 2024, Staff was notified by Commerce that an amendment to the agreement has been prepared and needs to be executed by the City.  The amendment generally addresses “house-keeping” items, including:

 

                     Changes the name of the department from the Florida Department of Economic Opportunity to the Florida Department of Commerce.

                     Makes minor changes to the procedures that the City and Commerce must follow to address Citizen Complaints related to this project and the grant (note that none are expected).

                     Makes minor changes to the section of the agreement that addresses the use of the E-Verify employment eligibility verification system (with which the City complies).

                     Makes minor changes to the project and grant closeout procedures.

                     Makes minor changes to the quarterly reporting requirements of the grant.

 

Staff has reviewed the amendment and concludes that it will have no significant impact on the City.

 

9.  The amendment has been reviewed and approved, as to legal form, by the City Attorney.

 

10. Staff, therefore, recommends City Commission approval of Amendment One to the Community Development Block Grant Mitigation Program Subrecipient Agreement between the State of Florida Department Of Commerce and the City Of Pembroke Pines for the design and construction of two generators at the wastewater treatment plant.
