MOTION TO ADOPT PROPOSED RESOLUTION NO. 2025-R-34.
PROPOSED RESOLUTION NO. 2025-R-34 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, APPROVING THE MEMORANDUM OF AGREEMENT (“MOA”) BETWEEN THE CITY AND THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (“FDOT”) FOR THE WIDENING OF PEMBROKE ROAD PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:
1. The City is widening Pembroke Road from 4 to 6 lanes from University Drive through Douglas Road. This is a joint project with the City of Miramar. This widening project is Metropolitan Planning Organization(“MPO”) funded due to the future traffic volumes. This is one of the last projects being designed and constructed by FDOT on local roads as they have discontinued this program. The City is now required to be Local Agency Program(“LAP”) certified and must design and construct projects using federal money on its own.
2. As part of this widening, a small portion of Cinnamon Place Park and a portion of Honeywoods HOA landscape area, both adjacent to Pembroke Road, will be needed as right of way(“ROW”).
3. The project will be installing a noise wall for a portion of the project adjacent to some of the homes in Honeywoods. At the start of this project, the ROW needed was to be acquired by a sale from landowner to FDOT.
4. Once the FDOT real estate group started the property acquisition process, they reviewed the plat and said that due to the language not stating the words “fee simple” that the properties are still owned by Levitt Homes, the original developer. Levitt Homes appears to be out of business.
5. The Honeywoods HOA, along with the Cities of Pembroke Pines and Miramar, had selected Alternative 2, the current roadway cross section, as that being the most desirable. Due to the issue of neither the City or the Honeywoods HOA owning the property to be acquired, the City asked FDOT if it would be possible to redesign the project to a smaller cross section (Alternative 3) minimizing the ROW acquisition needs. The FDOT response was that design it too far along to redesign.
6. FDOT is proceeding with land acquisition. If the City does not wish to be named in the land acquisition suit by FDOT against Levitt Homes for the Cinnamon Place Park, the City may sign a Memorandum of Agreement (“MOA”) between the City and FDOT vacating the platted dedicated right “to use for recreational purposes” parcel and execute Quit Claim Deed to the FDOT. When the property is acquired to be ROW within our jurisdiction, the property becomes the City’s.
7. FDOT is constructing a transportation project for the widening of Pembroke Road from Douglas Road to University Drive (“Project”).
8. The City has certain platted dedicated rights for which FDOT needs to acquire for its Project.
9. The Parties agree to coordinate their efforts for the best interest of the public to promote the successful completion of the Project.
10. The City Commission finds that approving the MOA is in the best interests of the health, safety, and welfare of the citizens and residents of the City of Pembroke Pines.
