PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinance is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(2) states, “Professional services.  Contracts for professional services involving peculiar skill, ability, experience or expertise, which are in their nature unique and not subject to competitive bidding, or competitive proposals, are exempt from this section; however, state laws, such as the Consultants' Competitive Negotiation Act of the state statutes, as may be amended from time to time to the extent applicable, shall be followed.”

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval."

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. The City of Pembroke Pines Utilities Department utilizes deep injection wells at the Wastewater Treatment Plant to dispose of treated wastewater after required contaminant removal efficiencies are achieved.

 

2. The operating permits issued to the City of Pembroke Pines Utilities Department by the Florida Department of Environmental Protection (FDEP) require that a Mechanical Integrity Test (MIT) be performed at least once every five (5) years to ensure the structural integrity of the wells to perform as intended and in accordance with Florida Administrative Codes.

 

3. Connect Consulting, Inc. has provided a proposal which includes services to complete MIT activities for two, municipal deep injection wells, IW-1 and IW-2. These MIT activities includes Preparation and Submittal of MIT Plan to FDEP, Project Coordination, Field Oversight, Data Evaluation and Report Preparation.

 

4. The City Engineer has advised that the “Mechanical Integrity Testing of the Wastewater Treatment Plant Injection Wells” does not require the “services within the scope of the practice of architecture, professional engineering, landscape architecture, or registered surveying and mapping, as defined by the laws of the state, or those performed by any architect, professional engineer, landscape architect, or registered surveyor and mapper in connection with his or her professional employment or practice.”  Therefore, the “Consultant’s Competitive Negotiation Act” CCNA requirements do not apply to this Professional Services Contract.

 

5. The proposed testing is time sensitive and is a regulatory requirement of the Florida Department of Environmental Protection.

 

6. Recommend City Commission approve the professional services agreement between the City of Pembroke Pines and Connect Consulting, Inc. for Hydro-geological Consulting Services in an amount not to exceed $60,837, which includes an owner’s contingency of $10,000, pursuant to Section 35.18(C)(2) of the City’s Code of Ordinances.
