- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

-  Section 35.18(C)(3) states, "City Standard, single-source and sole-source commodities or services. City standard, single-source and sole-source commodities or services are exempt from competitive bidding."

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval."

 

 - Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

1.  The City of Pembroke Pines Police Department is requesting commission approval to purchase (1) MX908 Handheld Mass Spectrometer Chemical Detection System. 908 Devices Inc. holds several patents connected to the technology and are the sole manufacturer and distributor of the chemical detection system and device.

 

2.  On February 2, 2022, City Commission passed a motion authorizing participation in the Interlocal Agreement with Broward County, Florida to have Broward County designated as a qualified county in the opioid litigation statewide settlement in order to directly receive the regional funds portion of the settlement funds for opioid abatement in Broward County (Item No. 22-0063).

 

3.  To date, the City has received approximately $420,000 from the settlement, with a total projected settlement amount of $1,955,867 for 2022-2039.

 

4.  The MX908 Handheld Mass Spectrometer is being requested to facilitate narcotics identification following seizure of suspected controlled substances during investigations and traffic stops.

 

5.  The device is capable of detecting a wide range of drugs of abuse, including over 2,000 novel fentanyl analogs, as well as explosives and other hazardous chemicals, through advanced high-pressure mass spectrometry analysis. This technology allows for rapid, on-site identification of controlled substances often without the need to remove them from their packaging or receptacles. As a result, it enhances officer safety by minimizing exposure risks and helps maintain the integrity of the evidence chain of custody prior to trial. Additionally, electronic records ensure data integrity and secure record-keeping.

 

6.  The device delivers results in just 60 seconds to accelerate mitigation or prosecution efforts. The enhanced response time from the device would benefit efficiency of narcotics investigation by the Vice Intelligence & Narcotics Unit but is not intended to replace laboratory testing.
