Summary Explanation and Background

 

PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.15 defines an Invitation for Bid as “A written solicitation for competitive sealed bids with the title, date and hour of the public bid opening designated therein and specifically defining the commodities or services for which bids are sought.  The invitation for bid shall be used when the city is capable of specifically defining the scope of work for which a service is required or when the city is capable of establishing precise specifications defining the actual commodities required.  The invitation for bid shall include instructions to bidders, plans, drawings and specifications, if any, bid form and other required forms and documents to be submitted with the bid.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(A) states, "A purchase of or contracts for commodities or services that is estimated by the Chief Procurement Officer to cost more than $100,000 shall be based on sealed competitive solicitations as determined by the Chief Procurement Officer, except as specifically provided herein."

 

- Section 35.19 of the City's Code of Ordinances is titled "SEALED COMPETITIVE BIDDING PROCEDURE."

 

- Section 35.19(A) states "All sealed competitive solicitations as defined in § 35.18 shall be presented to the City Commission for their consideration prior to advertisement."

 

- Section 35.19(E)(5) states "The city reserves the right to waive any irregularities in the bids, as determined by the Chief Procurement Officer and approved by the City Manager."

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval.”

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $100,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. On August 20, 2025, the City Commission authorized the advertisement of IFB # PSPW-25-11 “Roof Replacement of City Wide Roofs”, which was advertised on August 27, 2025.

 

2. The purpose of the solicitation was to replace the roofs of various city buildings, in accordance with the terms, conditions, and specifications contained in the solicitation.

3. On September 30, 2025, the City opened proposals from the following nine (9) vendors listed in ascending order.

4. Although LaPorta Contracting submitted the lowest proposal, their proposal only addressed the work to be done at Rose G. Price Park and was not the lowest bid for that site. Additionally, although Atlas Apex Roofing, LLC submitted the lowest bid for Rose G. Price Park, during the evaluation process, Atlas Apex Roofing LLC, informed the Procurement Department that they had summitted the wrong value for Rose G. Price Park. 

 

Paletz Roofing and Inspections, Inc. submitted the lowest overall proposal. Per standard practice, the Procurement & Public Services Departments requested a Schedule of Values from Paletz Roofing and Inspections, Inc. and Grace Roofing and Sheet Metal Enterprise to further verify the proposal of the apparent low bidders.

 

5. A portion of the requested pricing included optional work at R&R Village to re-sheet the entire roof deck with plywood. The vendors were requested to submit a price per square foot, and the estimated area is 4,000 square feet, with LaPorta providing the lowest unit price at $2.81 per square foot, which would equate to $11,240 for the additional work.  However, Paletz Roofing and Inspections, Inc. confirmed that they submitted a lump-sum price of $6,100 for this Optional Additional Work at R&R Village, in lieu of a price per square foot.  This work was designated as optional because it would be performed only if funding permitted. The Public Services Department has determined that the additional $6,100 for this additional work is fair, reasonable and within budget. With the inclusion of this optional scope, Paletz Roofing and Inspections, Inc.’s total bid amount is $516,040.

 

In addition to the optional work, the solicitation also requested pricing for Additional Work items. Vendors were required to provide unit-rate pricing for these items, which will be used on an as-needed basis. The contingency is intended to cover the cost of such work as it arises, consistent with standard roofing industry practices.

 

6. Upon evaluation of their Schedule of Values, the Public Services Department deemed Paletz Roofing and Inspections, Inc. to be the most responsive/responsible bidder for the proposed locations.

 

7. Request Commission to award IFB # PSPW-25-11 "Roof Replacement of City Wide Roofs" to the most responsive/responsible bidder, Paletz Roofing and Inspections, Inc., in the amount not to exceed $577,964.80, which includes the cost to provide payment and performance bonds in the amount of $10,320.80 and a 10% owner's contingency fee in the amount of $51,604.
