MOTION TO ADOPT PROPOSED ORDINANCE NO. 2026-08 ON SECOND AND FINAL READING
PROPOSED ORDINANCE NO. 2026-08 IS AN ORDINANCE OF THE CITY OF PEMBROKE PINES, FLORIDA, AMENDING THE FUTURE LAND USE ELEMENT OF THE CITY OF PEMBROKE PINES’ COMPREHENSIVE PLAN BY PROVIDING A TEXT AMENDMENT TO THE PERMITTED USES IN THE AGRICULTURAL LAND USE PLAN; PROVIDING FOR COMPLIANCE WITH FLORIDA STATUTES AND THE FLORIDA ADMINISTRATIVE CODE; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.

Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:
1. The City of Pembroke Pines is submitting a text amendment to the Future Land Use Element of the City’s Comprehensive Plan for the purpose of adding permitted uses to the Agricultural land use category.
2. The City initially proposed the following additional uses to the comprehensive plan:
• Communication facilities
• Public utilities such as, but not limited to, water and wastewater treatment plants, pumping stations, resource recovery facilities, recycling facilities, electrical substations, and electric lines and drainage facilities and structures, excluding electrical power plants.
3. The Planning and Zoning Board at its May 14, 2026, meeting voted to transmit this application to the City Commission and the Department of Commerce with a favorable recommendation.
4. The City Commission at its August 5, 2026 meeting voted to pass proposed Ordinance No. 2026-08 on first reading, excluding data centers use to the amendment language.
5. After discussion with the City Attorney's office, the following amended language is being submitted for consideration on second and final reading.
• Communication facilities, excluding data centers.
• Public utilities such as, but not limited to, water and wastewater treatment plants, pumping stations, resource recovery facilities, recycling facilities, electrical substations, electric lines, and drainage facilities and structures. Electrical power plants and data centers shall remain excluded from approved uses and shall be excluded from the definition of public utilities.
6. Following the City Commission review on first reading, the proposal, as amended, was transmitted to the Department of Commerce (Florida Commerce) for their review and comment.
7. The Department of Commerce issued a letter and had no comments on the proposed revision (See attached letter).
8. City administration recommends adopting Proposed Ordinance No. 2026-08 on second and final reading.
