PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinance is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

-  Section 35.18 of the City's Code of Ordinances is regarding "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

-  Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

-  Section 35.18(C)(3) states, "City Standard, single-source and sole-source commodities or services. City standard, single-source and sole-source commodities or services are exempt from competitive bidding."

 

-  Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission Approval."

 

- Section 35.21(A)(1) of the City’s Code of Ordinance states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1.  The Pembroke Pines Police Department is requesting to purchase the BolaWrap 150, a remote restraint device designed to be used by law enforcement early in an encounter of someone suffering from a mental health crisis, narcotic induced psychosis, or other uncooperative behaviors to deescalate situations rapidly so no other force is necessary.

 

2.  Wrap Technologies, Inc. is the Sole Source Manufacturer of non-lethal BolaWrap 150 products and ProForce Law Enforcement is the Sole Source Distributor for the State of Florida.

 

3.  The Pembroke Pines Police Department obtained a sole source letter from the manufacturer, Wrap Technologies, Inc., stating the following:

 

" Please accept this letter as confirmation that Wrap Technologies is the Sole Source Manufacturer of non-lethal BolaWrap 150 products and ProForce Law Enforcement is our Sole Source Distributor for the States of AK, AZ, CA, OR, WA, ID, UT, CO, NM, NV, MT, VY, OK and FL."

 

4.  ProForce Law Enforcement, has provided a quote for the twenty-eight (28) BolaWrap 150, with all related accessories, for a total cost of $44,992.14.

5.  Request City Commission to approve the purchase of twenty-eight (28) BolaWraps, a non-lethal remote restraint devices and accessories from the sole source law enforcement distributor for the State of Florida, Proforce Law Enforcement, for the Pembroke Pines Police Department, in an amount not to exceed $44,992.14, pursuant to Section 35.18(C)(3) of the City’s Code of Ordinances.
