PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS.”

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(5) states that, "Utilization of other governmental agencies' contracts. Commodities or services that are the subject of contracts with the state its political subdivisions or other governmental entities including the United States Government, are exempt from this section, provided, however, that this division shall apply only if the contract expressly permits or if the awarding jurisdiction and/or the vendor agree to allow the city to purchase therefrom and if either: (i) the commodities or services are the subject of a price schedule negotiated by the state or federal government or by competitive bid by another governmental agency and not on any preference; (ii) or the price offered for the commodity or service exactly equals or is lower than the governmental contract from vendors awarded the governmental contract. Where an award is made pursuant to this paragraph, the terms and conditions agreeable to the City may be used in lieu of those terms and conditions of the contract with the other governmental agency."

 

- Section 35.21 of the City's Code of Ordinances is regarding "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval.”

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. The City of Pembroke needs to purchase VMware vSphere Foundation 8 Licensing renewal. VMware is a software company that enables virtualization, allowing multiple virtual machines to run on a single physical server to improve efficiency and reduce hardware costs. Its technology powers data centers, cloud infrastructure, and virtualized environments across various industries, helping to manage resources and support cloud computing.

VMware vSphere Foundation 8 includes several key components for virtualization and workload management:

 

-                     vSphere Enterprise Plus: Provides virtualization and management features like vSphere ESXi for hosting VMs and Tanzu Kubernetes Grid for running Kubernetes workloads.

-                     vCenter Server Standard: A centralized management tool for controlling and automating multiple vSphere hosts and virtual machines.

-                     Aria Suite Standard: A suite for monitoring and operations management, including Aria Operations and Aria Operations for Logs for streamlined monitoring and troubleshooting.

-                     vSAN Enterprise: A storage virtualization feature with a basic allocation (100 GiB per CPU core) that allows for scalable, shared storage across the environment.

 

2. The State of Utah, in conjunction with the National Association of State Procurement Officials Cooperative Purchasing Program (NASPO ValuePoint), issued Request for Proposal # SK18008 for "Cloud Solutions" resulting in Master Agreement with various vendors.

 

3.  The State of Florida entered into a Participating Addendum to the NASPO ValuePoint Cooperative Procurement Program Master Agreement, with an expiration date of September 30, 2026.  As a result, the State of Florida utilizes Alternate Contract Source (ACS) # 43230000-NASPO-16-ACS for State of Florida Agencies and other eligible users utilizing the pricing and options via NASPO ValuePoint Master Agreement.

 

4. The City of Pembroke Pines is an eligible user of the State of Florida Alternate Contract Source (ACS) # 43230000-NASPO-16-ACS.  As defined by Florida Administrative Code Rule 60A-1.001(4)(e), eligible user means "Political subdivisions, including counties, cities, towns, villages and districts, as described be Section 1.01(8), F.S., and instrumentalities thereof."

 

5.  The agreement includes discounts off the retail price.  The Procurement Department requested quotes, from all twenty-seven vendors listed on the contract, for 600 VMware vSphere Foundation 8 Licenses. Quotes were received from the following vendors:

Request Commission to approve the purchase of six hundred (600) VMware vSphere Foundation 8 Licenses from NWN Corporation, utilizing an Alternate Contract Source (ACS) # 43230000-NASPO-16-ACS, in an amount not to exceed $100,134, pursuant to Section 35.18(C)(5) of the City's Code of Ordinances.
