MOTION TO APPROVE THE PURCHASE OF SHADE STRUCTURE FROM SHADE SYSTEMS INC. UTILIZING PRICING ESTABLISHED BY ALACHUA COUNTY BID NO. IFB-24-13, FOR A PURCHASE AMOUNT NOT TO EXCEED $105,818.90, PURSUANT TO SECTION 35.18(C)(5) OF THE CITY'S CODE OF ORDINANCES.

PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is regarding "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(5) states that “Commodities or services that are the subject of contract with the state, its political subdivisions or other governmental entities including the United States Government, are exempt from this section.

 

- Section 35.21 of the City’s Code of Ordinances is titled “AWARD OF CONTRACT.”

 

- Section 35.21(A) of the City’s Code of Ordinances is titled “City Commission approval.”

 

- Section 35.21(A)(1) states, “An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed.”

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. East Campus Elementary playground has reached its useful life. Additionally, the rubber surface has uneven areas due to uprooting of abutting trees. The City plans to enhance the playground in order to meet the new playground requirements for safety and impact absorbing materials.

 

The shade structures will provide needed shade for the playgrounds as the large trees creating the uprooting of the existing surface will be removed.

 

2. On August 25, 2023, Alachua County, Florida issued IFB #24-13 “Sun Shade Structures and Misc. Accessories (Catalog Discount)”. Shade Systems, Inc., was awarded the agreement for a period of two years beginning October 4th, 2023.

 

3. The City received a quote provided by Shade Systems, Inc., in the amount of $105,818.90 based on the pricing established by the School Board of Alachua County contract # SBAC-IFB- 24-13, which includes various items under the contract pricing.   

 

4. Request Commission to approve the purchase of shade structure from Shade Systems Inc. utilizing pricing established by Alachua County Bid No. IFB-24-13, for a purchase amount not to exceed $105,818.90, pursuant to section 35.18(C)(5) of the City's Code of Ordinances.
