MOTION TO APPROVE THE FIRST AMENDMENT TO THE PROFESSIONAL CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF PEMBROKE PINES AND CHRISTINA CLEMENTE FOR OCCUPATIONAL THERAPY SERVICES  PROVIDED AT THE CITY OF PEMBROKE PINES CHARTER SCHOOLS FOR AN AMOUNT NOT TO EXCEED $40,000,PURSUANT TO SECTION 35.18(C)(2) OF THE CITY’S CODE OF ORDINANCES.

 

Summary Explanation and Background

 

PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinance is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(2) states “Contracts for professional services involving peculiar skill, ability, experience or expertise, which are in their nature unique and not subject to competitive bidding, or competitive proposals, are exempt from this section; however, state laws, such as the Consultants’ Competitive Negotiation Act of the state statutes, as may be amended from time to time to the extent applicable, shall be followed.”

 

- Section 35.21(A)(1) of the City’s Code of Ordinance states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

 

SUMMARY EXPLANATION AND BACKGROUND:

1. The  Individuals with Disabilities Education Act (IDEA) Act of 2004 mandates that public schools provide special education and related services to children with disabilities. Occupational therapy services are included as related services of specialized education authorized under the IDEA Act.

 

2. On February 13, 2020, the City entered into a Professional Services Agreement with Christina Clemente, for an initial one (1) year period, commencing July 1, 2019 and expiring June 30, 2020. The City of Pembroke Pines Charter Schools utilize Christina Clemente to provide occupational therapy services for charter school students (See Exhibit 1 - Christina Clemente Occupational Therapist -Master Agreement).

 

3. The City would like to amend the compensation verbiage on Christina Clemente's original agreement from $50.00 per hour to the same hourly rate but not to exceed $40,000 (See Exhibit 2 - Christina Clemente Occupational Therapist -1st Amendment).

 

4. Recommend City Commission approve the first amendment to the professional consulting services agreement between the City of Pembroke Pines and Christina Clemente for occupational therapy services provided at the City of Pembroke Pines Charter Schools for an amount not to exceed $40,000,  pursuant to Section 35.18(C)(2) of the City's Code of Ordinances.
