MOTION TO ADOPT PROPOSED RESOLUTION 2023-R-46.
PROPOSED RESOLUTION 2023-R-46 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, APPROVING THE UTILITY WORK BY HIGHWAY CONTRACTOR AGREEMENT BETWEEN THE CITY AND FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), ATTACHED HERETO AS EXHIBIT “A” AND INCORPORATED HEREIN; PROVIDING FOR UTILITY IMPROVEMENTS ALONG PINES BOULEVARD FROM 1-75 TO EAST OF NORTHWEST 118TH AVENUE; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO TAKE ANY AND ALL ACTION NECESSARY TO EFFECTUATE THE INTENT OF THIS RESOLUTION; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO FDOT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:
1. The Florida Department of Transportation (FDOT) has jurisdiction over SR-820/Pines Blvd and I-75 within the corporate limits of Pembroke Pines.
2. The FDOT is undertaking an improvement project to Pines Blvd. from the I-75 North on-ramp to east of NW 118 Ave. The improvements generally consist of repaving and restriping the existing roadway to extend the service life, improve rideability, and minor roadway widening.
3. Pembroke Pines owns and operates water and sewer infrastructure within the project limits, and said infrastructure is located within FDOT’s right-of-way via permit from FDOT. Conditions of the permit include that the City must relocate or adjust its infrastructure to accommodate the construction and finished road conditions, as required. FDOT has identified 6 sewer manholes and 40 water/sewer valve boxes that will need to be adjusted to match the finished grade of the new pavement.
4. Utilities Staff has reviewed the required work and concludes that it would be in the best interests of the City to have FDOT’s project contractor make the utility adjustments as part of their scope of work. The alternative would be to have the City’s utility operations contractor, Jacobs, perform this work at a cost. This would divert Jacobs’ forces from other, needed work and also potentially expose the City to financial penalties if competing demands for Jacobs’ crews resulted in delays to FDOT’s project.
5. To that end, FDOT has prepared a Utility Work by Highway Contractor Agreement wherein they will include the utility adjustments in the scope of their roadway project, at the City’s expense. The estimated cost to the City of this agreement is $30,430.40 which includes 2% for allowances and 10% for contingencies. Any portion not used for this work will be refunded to the City. Likewise, an increase in the cost of the work will be at the City’s expense. The funds are due to FDOT 45 calendar days prior to the date on which FDOT advertises the project for bid (this date is not yet set but FDOT will provide sufficient notice to the City).
6. Staff recommends that the City Commission adopt proposed Resolution No. 2023-R-46.
