MOTION TO ADOPT PROPOSED RESOLUTION NO. 2025-R-23
RESOLUTION NO. 2025-R-23 IS A RESOLUTION OF THE CITY COMMISSION OF PEMBROKE PINES, FLORIDA, APPROVING AND AUTHORIZING THE PURCHASE OF REAL PROPERTY FROM WINDMILL RESERVE HOMEOWNERS ASSOCIATION, INC., GENERALLY LOCATED ALONG THE NORTHERLY SIDE OF FUTURE PEMBROKE ROAD EXTENSION AND WEST OF 196TH AVENUE, FOR A NEGOTIATED AMOUNT OF $1,500,000.00, SUBJECT TO THE TERMS AND CONDITIONS AS SET FORTH IN THE PURCHASE AND SALE AGREEMENT, ATTACHED HERETO AS EXHIBIT “A” AND INCORPORATED HEREIN BY REFERENCE; AUTHORIZING AND DIRECTING THE PROPER CITY OFFICIALS TO TAKE ANY AND ALL ACTION NECESSARY TO EFFECTUATE THE INTENT OF THIS RESOLUTION AND TO EFFECTUATE THE ACQUISITION OF SUCH REAL PROPERTY IN ACCORDANCE WITH THE TERMS OF THE PURCHASE AND SALE AGREEMENT AND ANY AMENDMENTS THERETO; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:
1. The City of Pembroke Pines seeks to acquire +/- 59.23 acres of land from Windmill Reserve Homeowners Association, the parcels (reference tax ID 513923010021 and 513923010032) are generally located north of the future Pembroke Road and west of 196th Avenue.
2. The City negotiated an Agreement for Purchase and Sale for the land and has attached the agreement as well as related exhibits to this agenda item.
3. Per City Charter section 8.08 (b) the City Commission may acquire property within or outside the corporate limits of the City for any municipal purpose, in fee simple or any lesser interest or estate, by purchase, provided such amount of expenditure for real property shall not exceed twenty-five (25%) percent of the current annual fiscal budget of the City.
4. The City has agreed to purchase the property for $1,500,000 ($25,325 per acre); subject to the terms and conditions set forth in the attached agreement. The property is considered wetlands and this is reflected in the valuation.
5. The City has obtained two appraisals for the subject property; the valuations are as follows:
A. Newstreet: $1,000
B. Vance: $2,561,000
6. The seller has also provided an appraisal, the valuation is as follows:
A.Gonzalez: $2,940,000
7. Prior to closing, the City will obtain an updated survey and conduct the required due diligence as noted in the attached agreement. All items will be ordered upon approval of proposed resolution 2025-R-23.
8. Administration, recommends adoption of proposed Resolution No. 2025-R-23 authorizing the purchase of +/- 59.23 acres of real property.
