MOTION TO APPROVE THE PURCHASE OF FIFTY-FOUR (54) ZOLL CARDIAC SCIENCE POWERHEART G5 FULLY AUTOMATED EXTERNAL DEFIBRILLATORS (AED'S) FOR THE POLICE DEPARTMENT FROM ZOLL MEDICAL CORPORATION’S AUTHORIZED RESELLER, CORO MEDICAL, LLC. UTILIZING THE STATE OF OKLAHOMA CONTRACT NUMBER OK-SW-300, IN AN AMOUNT NOT TO EXCEED $75,330, PURSUANT TO SECTION 35.18(C)(5) OF THE CITY'S CODE OF ORDINANCES.

PROCUREMENT PROCESS TAKEN:

- Section 35.18 of the City's Code of Ordinances is regarding "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."
- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"
- Section 35.18(C)(5) states that, "Utilization of other governmental agencies' contracts. Commodities or services that are the subject of contracts with the state its political subdivisions or other governmental entities including the United States Government, are exempt from this section, provided, however, that this division shall apply only if the contract expressly permits or if the awarding jurisdiction and/or the vendor agree to allow the city to purchase therefrom and if either: (i) the commodities or services are the subject of a price schedule negotiated by the state or federal government or by competitive bid by another governmental agency and not on any preference; (ii) or the price offered for the commodity or service exactly equals or is lower than the governmental contract from vendors awarded the governmental contract. Where an award is made pursuant to this paragraph, the terms and conditions agreeable to the City may be used in lieu of those terms and conditions of the contract with the other governmental agency."

SUMMARY EXPLANATION AND BACKGROUND:
1. The Police Department is requesting authorization to purchase fifty-four (54) Zoll Cardiac Science Powerheart G5 Fully Automated External Defibrillators (AED's) and supporting accessories.
2. The Police department selected AED’s manufactured by Zoll Medical Corporation because the selected model, the Powerheart G5 AED, combines ease of use with advanced technology. Intellisense™ CPR (ICPR) offers real-time, guideline-driven feedback, while a dual-language feature helps ensure that all rescuers can deliver high-quality CPR to help save the life of a sudden cardiac arrest victim.
3. The State of Oklahoma Contract Number OK-SW-300 awarded two manufacturers, Zoll Medical Corporation and Physio-Control, Inc. Each of these manufacturers produces their own AEDs, so the Procurement Department only requested quotes for the requested model from Zoll Medical Corporation.
4. The Procurement Department emailed a quote request to the eight authorized Zoll dealers listed under the State of Oklahoma Contract Number OK-SW-300. Although 51 dealers are included in this contract, only eight are authorized to distribute in Florida. These eight authorized dealers are listed below in alphabetical order:
