MOTION TO ACCEPT THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PEMBROKE PINES AND BROWARD COUNTY SHERIFF’S OFFICE (BSO), FOR THE CITY’S ACCEPTANCE OF THE FY 2022 U.S. DEPARTMENT OF JUSTICE/JUSTICE ASSISTANCE GRANT (JAG) AWARD IN THE AMOUNT OF $24,481. BSO WILL PROVIDE THE ADMINISTRATIVE SERVICES REQUIRED OF BROWARD COUNTY AND FACILITATE COMPLIANCE WITH THE REQUIRED CONDITIONS OF THE GRANT.

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

1. In collaboration with eighteen (18) eligible law enforcement agencies in Broward County, the Police Department has been allocated $24,481 from the U.S. Department of Justice as its FY2022 Justice Assistance Grant (JAG) share of the $546,715 allocated to the Broward County region. The Justice Assistance Grant funds may be used for any legitimate law enforcement projects, as defined by the Bureau of Justice Assistance. The funding allocation is determined by a formula that is based primarily upon the preceding year crime data reported to the F.B.I. and population trends.

 

2. The 18 participating agencies, which includes the City of Pembroke Pines Police Department, formed a working committee and developed a course of action to achieve the goals and objectives of the Edward Byrne Justice Assistance Grant / JAG Program, and have selected Broward County to receive the grant funds, administer the program and serve as the fiscal agent for the disbursement of all funds received for the JAG Program.

 

3. On December 14, 2022, the City Commission approved a motion to accept the memorandum of understanding and subaward agreement between the City of Pembroke Pines and Broward County for the City’s acceptance of the FY 22 U.S. Department of Justice/Justice Assistance Grant (JAG) Award in the amount of $24,481.

 

4. After the U.S. Department of Justice approved Broward County’s FY22 JAG applications, Broward County presented the City with a Memorandum of Understanding (MOU) and FY22 JAG Agreement for execution.

 

5. On or about September 29, 2023, Broward County entered into a subgrant award agreement with Broward County Sheriff’s Office (BSO) to serve as the lead agency in administering the grant on behalf of Broward County, through its Addendum to the Subgrant Award Agreement between Broward County and the Sheriff of Broward County for Administration of the FY22 Edward Byrne Memorial Justice Assistance Grant, entered on May 15, 2024.

 

6. As a result, the subrecipients of the 2022 Edward Byrne Justice Assistance Grant are required to enter into a Memorandum of Understanding (MOU) with BSO, to properly allow BSO to take the lead in the administration of this grant. The City of Pembroke Pines Police Department received this MOU from BSO on April 23, 2025.

 

7. Broward County Sheriff’s Office (BSO) will monitor implementation, reporting, and payment requests from the participating agencies and will deduct 7.02% of the City’s award for administrative and management purposes. The resulting net Pembroke Pines allocation will be $22,762.43. 

 

8. BSO shall confirm the accuracy of program activities and expenses, and upon review of participating agencies’ payment request, BSO shall forward approved reimbursement requests to Broward County for payment so that Broward County can disperse the funds directly to participating agencies.

 

9. There is no required match for this grant. The grant period will be from October 1, 2021, through September 30, 2025, a period of four (4) years.

 

10. The police department’s FY22 JAG project will be the purchase of (2) radar speed trailers.

 

11. The accompanying memorandum of understanding has been approved to form by the City Attorney’s Office.

 

12. Request City Commission to accept the Memorandum of Understanding (MOU) between the City of Pembroke Pines and Broward County Sheriff’s Office (BSO), for the City’s acceptance of the FY 2022 U.S. Department of Justice/Justice Assistance Grant (JAG) award in the amount of $24,481. BSO will provide the administrative services required of Broward County and facilitate compliance with the required conditions of the grant.

 

Financial Impact

FINANCIAL IMPACT DETAIL:

 

a)   Initial Cost: $22,762.43 in grant funds will be spent; no city funds will be involved.

b)   Amount budgeted for this item in Account No: Accounts will be created after commission approval of this item and JAG agreement is executed, Revenue account: 124-000-3018-331263-0000-000-0000-02022 and Expenditure account: 124-521-3018-552650-0000-000-0000-02022.

c)   Source of funding for difference, if not fully budgeted: Not Applicable

d)   5-year projection of the operational cost of the project: Grant funds must be expended by September 30, 2025, unless the grant deadline is extended, which has been common in the past due to the lengthy approval process for all participating agencies.  Any unspent funds are rolled over into the next fiscal year.

FEASIBILITY REVIEW:

A feasibility review is required for the award, renewal and/or expiration of all function sourcing contracts.  This analysis is to determine the financial effectiveness of function sourcing services.
