PROPOSED RESOLUTION NO. 2023-R-23 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA APPROVING THE SKYRISE TOWNHOMES PLAT FOR THE APPROXIMATE 6.74-ACRE PROPERTY GENERALLY LOCATED SOUTH OF PINES BOULEVARD AND WEST OF SOUTHWEST 184 AVENUE, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

 

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1.  Dennis Mele, agent for contract purchaser, has submitted a plat application for the Skyrise Townhomes Plat (FKA: Skyrise Plaza Plat), generally located south of Pines Boulevard and west of Southwest 184 Avenue.  The applicant requests the following as part of this application:

                    

                                          Replat the property. Change the name of the new plat from “Skyrise Plaza Plat” to “Skyrise Townhomes Plat”.

                                          Update the restrictive note to allow 54 townhouse units on parcel A of the property.

 

2.  The City previously approved the following applications for this property:

 

                                        March 3, 2005 -The Board of Adjustment approved a variance from minimum finish floor elevation requirements (ZV 2004-40 - variance expired due to inactivity).

                                        April 6, 2005 - City Commission approval of the Skyrise Plaza Plat allowing for the development of 77,500 office use and 2,500 square foot restaurant on Tract A and conservation area on Tract B. (SUB 2004-01)

                                         December 9, 2005 - City Commission approval of a 4-story, 78,924 gross square foot building with 2,500 square feet of restaurant use and 76,424 square feet of office.  SP 2004-55 (Never built - site plan expired)

 

3.  The following related items are being heard concurrently at tonight's meeting:

                     A rezoning application ZC 2022-02 (Proposed Ordinance No.  2023-03) with flexibility unit allocation request, consistent with the replat 

                      A municipal dedication agreement (Ref item 23-0503) for this site.

 

4.  SURROUNDING PROPERTIES:

 

The existing zoning and land use plan designations of the surrounding properties are as follows:

5. ACCESS:

 

Direct access to this property will be via the following locations:

 

                     A proposed 50' wide access opening at the northwest corner of this plat.  This access opening will serve as entry for Tuscan Pines as well as the Skyrise Townhomes site.

                   An existing opening off Pines Boulevard to the 184 Plaza property to the east (Cross access)*.

 

* A 24 -foot access easement on this plat will connect the Tuscan Pines property, the subject townhouses and the commercial parcels to the east, allowing internal parking lot access to Southwest 184 Avenue without needing to travel on Pines Boulevard.

Upon construction of this site, the existing opening to theTuscan Pines (Stellar Pembroke Pines) project will be closed as well as the temporary access drive (westernmost) on the 184 Plaza (Pines 5 Acre Plat) to the east. 

 

The City traffic engineering consultant (Marlin Engineering) provided the City a letter addressing the proposed access changes.  Marlin concludes that the change in access, combined with access closures and future median improvements (left turn in to site on Pines Boulevard) will result in less u-turns at SW 186 Avenue and overall safer access to this site.

 

 

6. ADDITIONAL DETAILS:

 

The site will include a 59’ landscape buffer easement along the Pines Boulevard frontage.

 

A municipal dedication requirement for a portion of this property will also need to be accepted by City Commission as required under Section 154.36 of the City Code of Ordinances.

 

7. The Planning and Zoning Board to City Commission with a favorable recommendation

1.                     City Commission adoption of Zoning Change application ZC 2022-02 with associated flexibility unit allocation.

2.                     Satisfaction of Broward County comments.

3.                     City Commission approval of a municipal dedication for this replat.

 

8.   The applicant was granted a request to defer this rezoning application as well as related re-plat and municipal dedication of subject property at the September 6, 2023 City Commission meeting until a time uncertain.  The applicant later requested these applications be heard at tonight's meeting.

 

9.  Administration recommends approval of proposed resolution No. 2023-R-23.
