PROPOSED RESOLUTION NO. 2026-R-10 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA (CITY) APPROVING THE AMENDMENT TO THE COMMUNITY AESTHETIC FEATURE AGREEMENT (CAFA) BY AND BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) AND THE CITY FOR THE INSTALLATION OF A REPLACEMENT GATEWAY ENTRY MONUMENT SIGN ON STATE ROAD 823 (FLAMINGO ROAD), NORTH OF PEMBROKE ROAD AND AUTHORIZING AN EXISTING UNPERMITTED GATEWAY ENTRY MONUMENT SIGN ON STATE ROAD 817 (UNIVERSITY DRIVE), SOUTH OF SHERIDAN STREET, AFFIRMING THE CITY'S INTENT TO FUND ALL COSTS FOR THE DESIGN, INSTALLATION AND MAINTENANCE OF THE PROJECT; DIRECTING THE APPROPRIATE CITY OFFICIALS TO TAKE ANY AND ALL ACTION NECESSARY TO EFFECTUATE THE INTENT OF THIS RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:
1. On May 21, 2014, the City Commission approved a construction contract with Acolite & Claude United Sign Co. (Agenda File 14-3083) for the design, fabrication, and installation of the City’s new Gateway Entry Monument Signs and directional signs.
2. Because some of the planned Gateway Entry Monument and directional signs were to be located within FDOT roadway rights-of-way, FDOT required the City to enter into a Community Aesthetic Feature Agreement (CAFA).
3. As part of the approval process, FDOT also required the City to adopt a Resolution confirming its approval of the project and its commitment to fund all costs associated with the design, installation, and maintenance of the proposed signs within FDOT roadway rights-of-way.
4. On August 3, 2016, the City Commission adopted Proposed Resolution No. 2016-R-27, authorizing the City of Pembroke Pines to enter into a Community Aesthetic Feature Agreement (CAFA) with the Florida Department of Transportation for the installation of four (4) Gateway Entry Monument Signs within FDOT roadway rights-of-way.
5. Four (4) Gateway Entry Monument Signs were authorized and permitted by FDOT under Permit No. 2015-M-491-0004, dated September 28, 2016, for installation within FDOT roadway rights-of-way in accordance with the original CAFA (refer to “FDOT Permit 2015-M-491-0004 Sign Location Map” for original permitted locations).
Subsequently, under FDOT Permit Modification No. 2015-M-491-0004 MOD, dated November 17, 2016, a fifth Gateway Entry Monument Sign was authorized as part of an amendment to the CAFA. However, a total of seven (7) Gateway Entry Signs were ultimately installed within FDOT roadway rights-of-way, as reflected in the “Additional Gateway Entry Signs Locations Exhibit.”
One (1) of the two (2) unauthorized/unpermitted Gateway Entry Signs-located within the Flamingo Road right-of-way, north of Pembroke Road-was later damaged in a vehicle crash. During the FDOT permitting process for the replacement sign, FDOT advised the City that an amendment to the existing CAFA would be required to authorize both the replacement sign at this location and the existing unpermitted Gateway Entry Sign located within the University Drive (SR 817) right-of-way, south of Sheridan Street, along the west side.
6. It is requested that the City Commission adopt Proposed Resolution No. 2026-R-10, authorizing the City of Pembroke Pines to amend the current Community Aesthetic Feature Agreement (CAFA) with the Florida Department of Transportation (FDOT).
This amendment will allow for:
The installation of a replacement Gateway Entry Monument Sign on Flamingo Road (SR 823), north of Pembroke Road; and the authorization of the existing unpermitted Gateway Entry Sign on the west side of University Drive (SR 817), south of Sheridan Street.
7. The replacement cost is estimated at approximately $28,000 and the Public Services Department and Engineering Division will work with the Procurement Department to procure the necessary services in accordance with the City's purchasing requirements.
