MOTION TO ADOPT PROPOSED RESOLUTION NO. 2026-R-02.

 

PROPOSED RESOLUTION NO. 2026-R-02 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, APPROVING THE CITY OF PEMBROKE PINES (“CITY”) TO ACCEPT TWO (2) SPECIAL WARRANTY DEEDS FROM THE CHAPEL TRAIL CORPORATE PARK ASSOCIATION, INC. FOR PROPERTY WHICH WILL BE USED FOR A DRAINAGE AND WATER MANAGEMENT AREA; AUTHORIZING THE CITY MANAGER TO EXECUTE THE TWO (2) SPECIAL WARRANTY DEEDS FOR THE PURPOSE OF ACKNOWLEDGING AND AGREEING TO THE RESTRICTIVE COVENANTS AND CONDITIONS ATTACHED AS EXHIBIT “B” TO THE SPECIAL WARRANTY DEEDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

1. The City and the South Broward Drainage District(District) have identified a Capital Improvement Project (“CIP”) called the Pembroke Pines Seepage Management Pump Station Project (“CIP Project”) to be located in western Pembroke Pines at Taft Street and NW 209th Avenue. The CIP Project is a joint project between the District and the City of Pembroke Pines (“City”) with the goal and objective of improving flood protection for the businesses and residential properties within the District’s S-9 and S-10 Drainage Basins.

 

2. The District and the City, in association with the engineering firm CPH Consulting, LLC., a Delaware limited liability company, have prepared engineering plans for the proposed construction of the CIP Project. The seepage management pump station is proposed to be located at Taft Street and NW 209th Avenue in Pembroke Pines, adjacent to a lake commonly known as Hidden Lake.  Hidden Lake is owned by the District, and the seepage management pump station is proposed to be located on property that is currently owned by the Chapel Trail Corporate Park Association, Inc. (“Association”), a not-for-profit Florida Corporation.

 

3. The construction of the CIP Project is dependent upon the District and the City obtaining permission and authorization from the Association to construct the pump station on the Association’s property. The Association desires to convey the seepage management pump station property via a Limited Warranty Deed to the District (“Pump Station Parcel”). As a condition of the transfer of the Pump Station Parcel, the Association which owns additional land that borders Hidden Lake is requesting the District and the City accept deeds to three other parcels. A depiction of the land that the Association desires to deed over to the District and the City is attached hereto as Exhibit “1”. There are a total of four (4) separate parcels of land that the Association desires to deed over to the District and the City with two (2) parcels of land proposed to be deeded over to the District and the two (2) parcels of land proposed to be deeded over to the City, are depicted on Exhibit “1”.   

 

4. In addition to the Pump Station Parcel, the Association desired to convey the lake perimeter Drainage and Water Management Area to the District via a second Limited Warranty Deed (“Lake Perimeter Parcel”).  The intent to accept both parcels by the District was approved under Resolution No. 2025-08 at the November 20th, 2025 Board Meeting.

 

5. The Association desires to convey 2 adjacent parcels to the City. After conveyance, the City must keep all existing conservation easements in place in perpetuity and perform maintenance of the parcels.

 

6. The first is the Dry Land and Drainage Parcel on the southwest and southern shore of Hidden Lake and is the parcel contained in the Limited Warranty Deed for the Dry Land and Drainage Parcel attached hereto as Exhibit “2”. The legal description of Dry Land and Drainage Parcel is attached as Exhibit “A” to the Dry Land and Drainage Parcel Limited Warranty Deed. The Restrictive Covenants and Conditions applicable to the Limited Warranty Deed for the Dry Land and Drainage Parcel are attached as Exhibit “B”.

 

7. The second of two adjacent parcels the Association desires to convey is the Lake Conservation Parcel containing a conservation easement on the southwest and southern shore of Hidden Lake and is the parcel contained in the Limited Warranty Deed for the Lake Conservation Parcel attached hereto as Exhibit “3”. The legal description of Lake Conservation Parcel is attached as Exhibit “A” to the Lake Conservation Parcel Limited Warranty Deed. The Restrictive Covenants and Conditions applicable to the Limited Warranty Deed for the Lake Conservation Parcel are attached as Exhibit “B” .

 

8. The City has determined that it is in the best interest of the City to acquire the Dry Land and Drainage Parcel and the Lake Conservation Parcel from the Association and the City desires to accept the Limited Warranty Deeds for the Dry Land and Drainage Parcel and the Lake Conservation Parcel from the Association and the City Commission finds that accepting two (2) limited warranty deeds from the Association for property which will be used for a drainage and water management area is in the best interests of the health, safety, and welfare of the citizens and residents of the City of Pembroke Pines.

 

9. Staff recommends the City Commission adopt Proposed Resolution No. 2026-R-02.
