MOTION TO APPROVE A PUBLIC USE ENCROACHMENT AGREEMENT WITH BOYD PANCIERA FUNERAL HOME.

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

1.  The Boyd Panciera Funeral home (AKA DMJ Funeral Properties) generally located at 6400 Hollywood Boulevard has been undergoing renovations.  According to the property appraiser page the previous building was constructed in the early 1980s, however the business has been in place since 1959.

 

2.  South and east of the funeral home is a public use right of way that divides their property (see attached imagery).

 

3.  The right of way begins at SW 64th Way and connects to Pines Boulevard behind the funeral home

 

4.  The funeral home is proposing to install and maintain a fence along the right of way as part of their renovation project to buffer the funeral home from the adjacent residential properties.

 

5.  The funeral home has also agreed to remove the crumbling louvered concrete fence that follows portions of the property line between the residential and commercial properties.

 

6.  The right of way abuts the following properties:

  A. Boyd Panciera Funeral Home, 6400 Hollywood Boulevard

  B. Giant Oil Inc (BP), 6450 Hollywood Boulevard

  C. Residential Property, 6451 SW 2nd St

  D. Residential Property, 6441 SW 2nd St

  E. Residential Property, 6431 SW 2nd St

  F. Residential Property, 6421 SW 2nd St

  G. Residential Property, 6411 SW 2nd St

  H. Residential Property, 100 SW 64th Ave

 

7.  The proposed Public Use Encroachment Agreement will allow for the installation of the proposed fence.

 

8.  Administration recommends that the Commission approve the Public Use Encroachment Agreement with Boyd Panciera Funeral Home (AKA DMJ Funeral Properties, LLC).
