PROCUREMENT PROCESS TAKEN:


- Chapter 35 of the City’s Code of Ordinance is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(7) states that "The following contractual services are not subject to the competitive procurement requirement:"

 

- Section 35.18(C)(7)(B) states that "Health services involving examination, diagnosis, treatment, prevention, medical consultation or administration;"

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval".

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

1. The Fire Rescue Department cannot legally provide medical services without being under the control and supervision of a Medical Director. Therefore, the Fire Rescue Department has established an agreement for Medical Director Services with Dr. Steven H. Katz, MD, FACEP, which operates under S Katz, Inc., allowing the Fire Rescue Department to provide advanced life support under a licensed physician.

 

On June 18, 2025, City Commission approved a new agreement with S Katz, Inc. for Medical Director Services for the Fire Rescue Department in an amount not to exceed the annual fee of $41,706.08, commencing on October 1, 2025, and expiring on September 30, 2026, with an option to renew for additional one (1) year term.

 

2. The City’s Fire Department is in the process of implementing its own EMT Training Program, to be conducted at the City’s Fire Training Facility. Pursuant to chapter 401, Florida Statutes, it is required to employ a Medical Director to provide clinical oversight, accountability, and maintain regulatory and licensing compliance with state and national standards, for EMT Training Programs.

 

3. The City and Medical Director (“Parties”) desire to amend the Original Agreement, to include the services and responsibilities of the Medical Director in connection with the EMT Training Program, as described in Exhibit “B.”

 

4.The agreement is further amended to include an increase in compensation in the amount of $524.49 a month, effective upon commencement of the EMT Training Program. The total compensation shall be subject to an annual increase of three percent (3%).

 

5. The Parties also desire to amend Section 3.1 of the Original Agreement to provide for an initial five (5) year term, commencing on October 1, 2025, and expiring on September 30, 2030. Thereafter, the Agreement may be renewed for successive five (5) year terms upon the mutual consent of the Parties.

 

6. The Fire Rescue Department recommends the approval of the First Amendment to the agreement between the City of Pembroke Pines and S Katz, Inc. for Medical Director Services for the Fire Rescue Department, to include clinical oversight and accountability for the EMT Training Program, for an initial five (5) year term with the option to renew for additional five (5) year terms.
