PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.15 defines an Invitation for Bid as “A written solicitation for competitive sealed bids with the title, date and hour of the public bid opening designated therein and specifically defining the commodities or services for which bids are sought.  The invitation for bid shall be used when the city is capable of specifically defining the scope of work for which a service is required or when the city is capable of establishing 15 precise specifications defining the actual commodities required.  The invitation for bid shall include instructions to bidders, plans, drawings and specifications, if any, bid form and other required forms and documents to be submitted with the bid.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(A) states, "A purchase of or contracts for commodities or services that is estimated by the Chief Procurement Officer to cost more than $25,000 shall be based on sealed competitive solicitations as determined by the Chief Procurement Officer, except as specifically provided herein."

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. On March 19th, 2025, the City Commission authorized the advertisement of IFB # PSPW-25-06 “Exterior Painting of Pembroke Pines Charter School - West Campus”, which was advertised on March 26th, 2025.

 

2. The purpose of the solicitation was to seek bids from qualified firms to paint the exterior of the Pembroke Pines Charter School West Campus, located at 18500 Pembroke Rd, Pembroke Pines, FL 33029.

 

The main purpose of repainting the school is to enhance its visual appeal and create a more positive, clean, and inviting environment for students and staff. Over time, constant exposure to sun, rain, humidity, and everyday wear has caused the walls and surfaces to deteriorate, resulting in fading, peeling, and damage that not only detracts from the school’s appearance but also risks compromising the building’s integrity.

 

A fresh coat of paint is essential to protect the school from damage caused by mold, mildew, and environmental elements. This preventative measure safeguards structural components, reducing the risk of costly repairs in the long term.

 

3. On April 29th, 2025, the City opened proposals from the following seventeen (17) vendors listed in ascending order of their total base price for Exterior Painting and Pressure Washing:

4. The bid also included unit pricing for stucco repair, expansion joints with backer rod, and polyurethane sealant. These line items were not included in the base bid totals because the actual quantities, measured in square feet or linear feet, could only be determined after the initial building preparation.  The building preparation, which follows the pressure cleaning process, will expose any underlying issues that may not be visible before. Estimated quantities would have only accounted for areas that could be visually inspected, leaving out significant sections that could only be identified once the building’s full condition is assessed.  The Public Services Department has estimated an allowance of $7,600 to cover these potential costs based on their visual inspection and anticipated needs prior to the building preparation and pressure washing, which is anticipated to reveal additional issues.

 

Additionally, the Public Services Department is requesting the inclusion of an owner's contingency in the amount of $7,293.76.

 

Including an owner’s contingency is a standard and prudent construction practice that provides a pre-approved reserve for addressing unforeseen conditions that may arise once the project is underway.  During construction activities, particularly in older buildings like the Charter Schools, underlying issues such as hidden structural damage, unexpected deterioration, or additional repair needs often only become visible after surface work begins and throughout the entire construction process.  These unforeseen issues need to be addressed and resolved immediately to minimize safety and operational concerns. 

 

Without an owner’s contingency, staff may be required to pause construction and return to the City Commission for approval of any unexpected costs.  This can cause significant delays, disrupt school operations, and ultimately result in increased construction costs due to extended timelines, contractor standby time, or remobilization.

 

For this project, the owner's contingency fee may include unforeseen costs related but not limited to additional quantities of stucco repair, expansion joints with backer rod, and polyurethane sealant around windows that can come up as work progresses.

 

5. The Public Services Department reviewed the proposals and deemed Industry Grade Construction Group to be the most responsive/responsible bidder.

 

6. In addition, Industry Grade Construction Group has also completed the Equal Benefits Certification Form and has stated that the “Contractor currently complies with the requirements of this section."

 

7. Request Commission to award IFB # PSPW-25-06 "Exterior Painting of Pembroke Pines Charter School - West Campus" to the most responsive/responsible bidder, Industry Grade Construction Group, Inc., in the amount not to exceed $87,831.36, which includes an allowance of $7,600 and an owner's contingency fee in the amount of $7,293.76.
