PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states, "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(7) states, "The following contractual services are not subject to the competitive bid procurement requirement:"

 

- Section 35.18(C)(7)(m) states, "Entertainment services (performing artists, entertainment and amusements at festivals or special events)."

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

SUMMARY EXPLANATION AND BACKGROUND:

1.  Zambelli Fireworks Manufacturing Co., has been providing the fireworks display for the City's annual Fourth of July fireworks celebration at Pines Recreation since 2016.  The previous agreement with Zambelli expired on July 5, 2023. 

 

2.  The City is seeking to establish a new two year agreement for the fireworks display for the Fourth of July celebrations in 2024 and 2025.

 

3.  The Recreation and Cultural Arts Department received a proposal from Zambelli for $35,000 per show to provide a 25 minute fireworks display with 1,215 shells.  This proposal is the same length of time and approximate shell count as provided in previous year's firework displays.  

 

4.  Section 35.18(C)(7)(m) of the Procurement Code allows exemptions from competitive bids and competitive proposals for "entertainment services (performing artists, entertainment and amusements at festivals or special events).  Producing a fireworks show is a creative process.  Every vendor has a variety of shell sizes and other explosive effects to produce a show. 

 

5.  Request Commission to approve the two year agreement for the annual Fourth of July fireworks display at Pines Recreation with Zambelli Fireworks Manufacturing Co., for $35,000 each year for a total contract amount not to exceed $70,000.
