PROPOSED ORDINANCE NO. 2025-10 IS AN EMERGENCY ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, PURSUANT TO SECTION 3.13 OF THE CITY’S CHARTER AND SECTION 166.041, FLORIDA STATUTES, APPROVING AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE THE FIFTH AMENDMENT TO THE AGREEMENT TO ENTER INTO SUB-SUBLEASE WITH HG PINES, LLC; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE.

 

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. The City may adopt certain Emergency Ordinances pursuant to the criteria set forth in Section 3.13 of the City’s Charter and Section 166.041, Florida Statutes.

 

2. On June 11, 2024, the City and HG Pines, LLC entered into an Agreement to Enter into Sub-Sublease (“Original Agreement”).

 

3.  On September 18, 2024, the City Commission of the City of Pembroke Pines approved the First Amendment to Agreement to Enter into Sub-Sublease in order to extend the Review Period under the Original Agreement.

 

4.  On November 20, 2024, the City Commission of the City of Pembroke Pines approved the Second Amendment to Agreement to Enter into Sub-Sublease in order to further extend the Review Period under the Original Agreement, as amended.

 

5.  On January 15, 2025, the City Commission of the City Pembroke Pines approved the Third Amendment to Agreement to Enter into Sub-Sublease in order to further extend the Review Period under the Original Agreement, as amended.

 

6.  On March 19, 2025, the City Commission of the City Pembroke Pines approved the Fourth Amendment to Agreement to Enter into Sub-Sublease in order to further extend the Review Period under the Original Agreement, as amended.

 

7. The parties deem it necessary to extend the term of the Review Period of the Original Agreement, as amended, prior to July 31, 2025, which is the current deadline for the Review Period.

 

8. The City Commission of the City of Pembroke Pines, Florida, deems it to be in the best interests of the public to adopt this Emergency Ordinance and approve and authorize the execution of a Fifth Amendment to the Agreement to Enter into Sub-Sublease with HG Pines, LLC to extend the Review Period under the Original Agreement, as amended prior to July 31, 2025, and in accordance with Section 3.13 of the City’s Charter and Section 166.041, Florida Statutes.

 

9. Request Commission pass Proposed Ordinance No. 2025-10 on Second and Final Reading.
