Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:

1. The City of Pembroke Pines and the School Board of Broward County have maintained a reciprocal use agreement since 2005. This agreement allows both parties to use each other's facilities, as outlined within its terms, without requiring repetitive documentation such as proof of insurance or indemnification for each individual request. Instead, either party simply submits a facility use request and obtains approval. While rental fees are waived for both parties, fixed costs, including custodial and energy expenses, may still apply when applicable.

2. The current agreement was approved by the City Commission on August 5, 2020 and expires on August 23, 2025.

3. The term of the proposed agreement is for five years with an expiration of August 23, 2030. Changes to the newly proposed agreement include changes to Section 2.06 which updates the custodial and energy fees when applicable. The new agreement also clarified the language in section 2.03.7 regarding City improvements to School Board property, if applicable, and vice versa.

4. The Recreation and Cultural Arts Department recommends approval of the agreement.

5. The Attached agreement has not been executed by the School Board of Broward County. They will be placing the same agreement on a future School Board agenda.

FINANCIAL IMPACT DETAIL:

a) Initial Cost: Currently the City only uses Flanagan High School track for one of the Youth Organizations and Pasadena Elementary softball field for spillover space for youth football.
