SUMMARY EXPLANATION AND BACKGROUND:
1. The Pembroke Road Expansion Project (MIRA 001-004), funded through the Broward County Surtax, is currently under design. As part of the project, new drainage culverts will be constructed at South Broward Drainage District (SBDD) Canal No. 7, west of SW 196th Avenue, and Canal No. 8, west of SW 208th Avenue. SBDD, as the permitting agency, is responsible for the maintenance and proper functioning of the waterway portions of the canals; however, SBDD requires the respective municipalities to assume responsibility for maintaining the proposed culvert improvements.
2. The City of Pembroke Pines will assume ownership and maintenance responsibilities for the portions of the culvert constructed within the SBDD Canal No. 7 right-of-way, while the City of Miramar will assume ownership and maintenance responsibilities for the portions of the culvert located within the SBDD Canal No. 8 right-of-way. Maintenance responsibilities will include conducting inspections at least once every five (5) years, desilting the culverts as needed, and performing routine repairs necessary to maintain their continued functionality.
3. Because each culvert extends across the municipal boundaries of both cities, assigning full maintenance responsibility for each respective culvert to one municipality provides a more efficient and administratively practical approach than dividing responsibility based strictly on individual right-of-way or jurisdictional boundaries. This approach will help ensure clear accountability, facilitate timely maintenance and repairs, and support the continued safe and effective operation of the drainage improvements.
