MOTION TO ADOPT PROPOSED ORDINANCE 2017-06 ON SECOND AND FINAL READING.

 

PROPOSED ORDINANCE 2017-06  IS AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA AMENDING CHAPTER 155 OF THE CITY’S CODE OF ORDINANCES ENTITLED “ZONING CODE,” BY AMENDING SECTION 155.800 ENTITLED “FEE SCHEDULE FOR DEVELOPMENT REVIEWS”  TO PROVIDE FOR AN UPDATED FEE SCHEDULE; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. As part of the upcoming budget preparations, City Planning and Economic Development Department staff performed an internal review of current development review application types as well as the fees provided for such functions.  The goal of this review was to find ways in which staff could increase efficiencies in internal development review processes and also to ensure that all Planning and Economic Development Department related review fees reflect actual staff time spent on applications.

 

2.  The proposed Ordinance provides for the following:

A.                     Adjusts Planning and Economic Development Department development fee schedule to reflect the following:

I.                     Fees have been adjusted on development review applications to be reflective of actual staff time spent on various application types.

                     Fees have been increased for some application types while others have been reduced.

                     Fees have been rounded to nearest dollar amount.

II.                     Application types have been added to the fees schedule (Address Plan Review, Administrative Revision, Non-Residential Accessory Structure Review)

B.                     Section 155.800 has been amended to remove the currently inaccurate fee schedule from City Code and to reference the latest fee schedule which will be made available at the Office of the City Clerk and on City webpage.

C.                     Any and all fee adjustments outside of CPI increases must be approved by the City Commission.

 

3.  City Code 155.800 currently contains a detailed list of Planning and Economic Development Department review applications and related fees.  This section of the Code relating to Planning fees was last amended in 2008.  Section 155.800 provides for updates to the fee schedule based on Consumer Price Index (CPI) changes from year to year. 

 

4.  CPI has changed several times since 2008 and therefore the fees listed in  code section 155.800 Fee Schedule for Development Reviews are not consistent with the fees listed in the section.

 

5.  The differences in the 2008 costs listed within section 155.800 and Planning and Economic Development Department current fee schedule (2008 fees - adjusted for CPI) has caused some confusion amongst developers and residents when discerning true development review application costs.

 

6.  Planning and Economic Development staff annually update an internal department fee schedule document to reflect the costs of applications based on changes to the CPI.   The current fee schedule is posted on the City’s webpage as well as provided to developers and residents during pre-application meetings.

 

7.  Staff recommends removing these development review fees from the section 155.800 of City Code of Ordinances and providing for reference to the City maintained fee schedule as well as to provide availability of this schedule through the Office of the City Clerk.  This approach is consistent to how the City references building permit fees per Section 150.16 of the Code of Ordinances. This ensures that the proper fee is distributed every year.

 

8.  Attached for reference is a matrix which shows the 2008 published Planning and Economic Development fees (155.800), current fees as of 2017, and newly proposed fees effective upon passage of this Ordinance. 

 

9. Recommend adoption of proposed ordinance 2017-06 on second reading.
