SUMMARY EXPLANATION AND BACKGROUND:
1. Each year, the Charter Schools budget funds for the purchase of new textbooks. Textbook purchases are determined by the adoption of State approved instructional materials for specific classes.
2. The Department of Education requires charter schools to purchase instructional materials from the Florida School Book Depository. However, the chemistry and newer edition statistic textbooks needed at the Academic Village Charter School to be in alignment with the charter school math and science curriculum are not available through the Florida School Book Depository due to stock shortages. Publisher Pearson offers the needed chemistry and statistic textbooks. The aforementioned textbooks are aligned with the School Board of Broward County's curriculum. The estimated cost of this purchase is as follows (See Exhibit #1- Pearson Quotes):

3. As per Section 35.18 (C)(7)(h) of our Procurement Code, Copyrighted materials are exempt from the Competitive Bidding process. Attached is a letter from the vendor stating that they are the sole publisher and copyright holder of the referenced textbooks (Exhibit #2- Pearson Copyright Holder Letters).
4. Recommend City Commission to authorize the purchase of the 2018-2019 chemistry and statistic textbooks that are required for the operation of the Academic Village Charter Schools from Pearson Education, Inc. in an amount not to exceed $28,275.50.
