Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

1.                     The City has applied to Broward County for approval of an amendment to the platted non-vehicular access line on the Hollywood Lakes Country Club and Resort Plat (a/k/a Grand Palms) (the “Plat Amendment”) to further the proposed improvements to Pembroke Road, and to establish an approved opening at the southwest corner of the Hollywood Lakes Country Club and Resort Plat (the “Plat”).

2.                     The approval of the Plat Amendment request is conditioned upon entering into the Traffic Signalization Agreement with Broward County, a copy of which is attached hereto as Exhibit “A”, and incorporated herein by reference.

3.                     The City has agreed to be responsible for all costs associated with the improvements listed in the Traffic Signalization Agreement.

4.                     Broward County finalized its evaluation and analysis of the total costs associated with the signalization improvements, and the cost for the improvements is estimated to be approximately $350,000.00.

5.                     The City Commission finds that it is in the best interest of the City to authorize the actual funds necessary to pay for the construction of the associated improvements as listed and required by the plat amendment if the cost of construction exceeds the current estimate of $350,000.00 as specified in the Traffic Signalization Agreement with Broward County associated with the Plat, and, therefore, authorizes the expenditure.

6.                     The City Commission of the City of Pembroke Pines does hereby approve the Traffic Signalization Agreement with Broward County associated with the Hollywood Lakes Country Club and Resort Plat, with the cost estimate of $350,000.00, a copy of which is attached hereto as Exhibit “A”, and incorporated herein by reference (the “Agreement”).  The City Commission hereby authorizes the appropriate City Officials to take any and all actions necessary to effectuate the intent of this Resolution. Further, the City Commission authorizes the City Manager to make any and all necessary modifications to the Agreement, with the concurrence of the City Attorney, as necessary, to effectuate the intent of the City Commission and achieve Broward County’s approval of the Agreement.

7.                     The City Commission of the City of Pembroke Pines does hereby agree to be bound by the covenants and requirements of the aforementioned Agreement and comply with all provisions required therein, and to authorize the actual funds necessary to pay for the construction of the associated improvements as listed and required by the plat amendment application if the cost of construction exceeds the current estimate of Three Hundred Fifty Thousand and 00/100 Dollars ($350,000.00) as required in the Traffic Signalization Agreement associated with the Hollywood Lakes Country Club and Resort Plat Amendment.

8.                     This Resolution shall become effective immediately upon its passage and adoption.
