Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

1.  On June 27, 2018, the City Manager approved a request from the City Engineer to issue an emergency purchase order to Thompson Pump & Manufacturing Co., Inc. in the amount of $124,536, for the purchase of two sewage lift station by-pass pumps utilizing the Florida Sheriffs Association's (FSA) Bid # FSA17-VEH15.0.

 

2.  These pumps will be used at the Raintree Development's lift station #192 and #187 located at 11329 SW 12 Street.  Normally the developer supplies the pumps, however, the City has been trying since August 2017 to have the developer supply the pumps.

 

3.  The Development has changed owners from Cal-Atlantic/Standard Pacific to Lennar Corporation.  Lennar Corporation guaranteed that they would reimburse the City 100% of the cost.

 

4.  The Utilities Division was in need of the emergency purchase of these pumps because of hurricane season.

 

5.  Per Section 35.18(C)(1) of the City's Procurement Code; "In urgent cases of compelling emergency that require the immediate purchase of commodities or services, the City Manager is empowered to waive competitive bidding or competitive proposals and authorize the Chief Procurement Officer to secure by open market procedure any commodities or services, notwithstanding the estimated cost of the commodities or services."

 

6.  Per Section 35.18(C)(5) of the City's Procurement Code; Utilization of other governmental agencies' contracts.  Commodities or services that are the subject of contracts with the state its political subdivisions or other governmental entities including the United States government, are exempt from competitive bids or proposals, provided, however, that this division shall apply only if the contract expressly permits or if the awarding jurisdiction and/or the vendor agree to allow the City to purchase therefrom.

 

7.  Lennar Corporation has already reimbursed the City the $124,536.

 

8.  Request Commission to ratify the City Manager's approval for the emergency purchase of two sewage lift station by-pass pumps from Thompson Pump & Manufacturing Co., Inc., for a total cost of $124,536, utilizing the Florida Sheriffs Association's (FSA) Bid # FSA17-Veh15.0.
