PROPOSED RESOLUTION 2018-R-40 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, URGING AND REQUESTING THE FLORIDA DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES TO DEPUTIZE THE CITY OF PEMBROKE PINES CODE ENFORCEMENT OFFICERS IN ORDER TO ALLOW THE CITY’S CODE ENFORCEMENT OFFICERS TO INSPECT GAS PUMPS TO PROTECT RESIDENTS FROM CREDIT CARD SKIMMER DEVICES AT FUELING STATIONS WITHIN THE CITY OF PEMBROKE PINES; AUTHORIZING ALL NECESSARY ACTIONS TO IMPLEMENT THE INTENT OF THIS RESOLUTION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

SUMMARY EXPLANATION AND BACKGROUND:
1. On September 17, 2018, Commissioner Castillo introduced an item for discussion and possible action to authorize a resolution to the State, requesting approval by the Florida Department of Agriculture to deputize City Code Compliance Officers.
2. Code Compliance Officers are Police Department staff of the City of Pembroke Pines, who would be deputized to inspect gas pumps located within city limits to protect residents from credit card skimming, in compliance with and subject to the legal standards and policies the Department of Agriculture, further supporting the use of departmental, executive or legislative powers to achieve this means which would offer greater protection against credit card information theft to City residents.
