Summary Explanation and Background

SUMMARY EXPLANATION AND BACKGROUND:

1.  The Recreation & Cultural Arts Department has funds budgeted for a new fairway mower for Pembroke Lakes Golf Course. The current unit (Asset #15263 ) has excessive hours and has become difficult to keep operational due to frequent repairs, negatively affecting maintenance of the golf course.

2.  The State of Florida has procured State Term Contract #21100000-15-1; "Agriculture and Lawn Equipment" and has awarded Group 12  "Utility Tractors: Greater than or equal to 40 hp but less than 145 hp", Sub Group 20 "Compact Utility Tractor: Greater than or equal to 40 hp but less than 75 hp" to Florida Coast Equipment, Inc. for Kubota Brand Equipment at 23.5% discount off of MSRP prices, Options and Accessories at 5% discount off of MSRP prices.

3.  Section 35.18(5) of the City's Procurement Procedures states; "Utilization of other governmental agencies' contracts.  Commodities or services that are the subject of contracts with the state its political subdivisions or other governmental entities including the United States government, are exempt from this section, provided, however, that this division shall apply only if the contract expressly permits or if the awarding jurisdiction and/or the vendor agree to allow the city to purchase therefrom and if either: (i) the commodities or services are the subject of a price schedule negotiated by the state or federal government or by competitive bid by another governmental agency and not on any preference; (ii) or the price offered for the commodity or service exactly equals or is lower than the governmental contract from vendors award...
