PROPOSED ORDINANCE 2019-02 IS AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA AMENDING TITLE VII OF THE CITY’S CODE OF ORDINANCES ENTITLED “TRAFFIC CODE” BY AMENDING SECTION 72.06 ENTITLED “NO PARKING WHEN POSTED” TO PROVIDE FOR THE ISSUANCE OF PARKING CITATIONS ON MUNICIPAL PROPERTY; BY AMENDING SECTION 70.99 ENTITLED “PENALTY” TO PROVIDE FOR FINES FOR MUNICIPAL TRAFFIC OFFENSES; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

 

 

 

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

1. The Director of Recreation & Cultural Arts has done an evaluation of the parking at City parks and City Center, especially overnight, and along City swales when the adjacent municipal building or park is closed. This evaluation was necessary due to the volume of overnight parking at City Center and City parks. The Pembroke Pines Police Department and Code Compliance placed electronic signage at strategic locations and sent notices to surrounding residences advising those using the lots that overnight parking was not permitted.  These measures did not produce any improvement in the use of City property for overnight parking. 

 

2. The City Attorney's office, the Pembroke Pines Police Department and the Recreation & Cultural Arts Department collectively reviewed possible solutions.  Staff determined amending title VII of the City's Code of Ordinances entitled "Traffic Code" would minimize illegal parking on muncipal property.  The affected sections are 72.06 "No parking when posted" which is being amended to provide for the issuance of parking citations on municipal property and section 70.99 "Penalty" which is being amended to provide for fines for municipal traffic offenses.  The Pembroke Pines Police Department and the Code Compliance Unit would be authorized to issue parking citations for overnight parking and parking along City swales when the building or park is closed. The proposed fee for citations issued under the amended chapter is $25.00 for each offense. 

 

3. The City of Pembroke Pines and Broward County Clerk of Courts have a current interlocal agreement dated February 29, 2006, addressing processing and collection of parking citations issued by the Pembroke Pines Police Department and Code Compliance.

 

4. The Police Chief is in agreement with this proposed ordinance.

 

5.  On May 15, 2019, the City Commission approved this item on First Reading.  During the meeting there was discussion about the impact of this ordinance on the residents in the surrounding communities within City Center. Commissioner Good questioned whether there were any exceptions or variances given to the residential communities surrounding City Center regarding their parking requirements.  Based on a review by the Planning and Economic Development Department, the Mixed Use Development (MXD) guidelines for City Center require a minimum parking ratio of 1.75 spaces per unit for the residential properties.  The ratio was approved by City Commission via rezoning.  The ratio within the guidelines provides sufficient parking for each development based on the composition of their unit mix (1, 2 or 3 bedrooms). Each of the residential projects within City Center exceeds the minimum requirements.

 

6. Recommend commission approve proposed ordinance 2019-02 on second and final reading.
