MOTION TO ADOPT PROPOSED RESOLUTION 2019-R-34.

 

PROPOSED RESOLUTION 2019-R-34 IS A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF PEMBROKE PINES, FLORIDA, APPROVING AND AUTHORIZING THE PROPER CITY OFFICIALS OF THE CITY OF PEMBROKE PINES TO EXECUTE THE MEMORANDUM OF UNDERSTANDING WITH BROWARD COUNTY AND OTHER PARTICIPATING MUNICIPALITIES REGARDING COLLABORATIVE STUDY AND SUBSEQUENT DEVELOPMENT OF AN INTEGRATED SOLID WASTE AND RECYCLING SYSTEM, ATTACHED HERETO AS EXHIBIT “A” AND INCORPORATED HEREIN; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. 

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

1. Broward County entered into an Interlocal Agreement (ILA) in 1987 with 26 municipalities (the"RRB municipalities"), which created the Resource Recovery Board (RRB) and Resource Recovery System (RRS).  The City of Pembroke Pines was not a member of the RRB. Rather, the City has an agreement with Reuter Recycling of Florida, Inc., for the disposal of solid waste ("Reuter Agreement").  The Reuter Agreement expires on January 1, 2022.

 

2.The ILA termed out in 2013 leaving all parties individually responsible for the disposal of their solid waste streams.  The assets of the RRS, with the exception of the Alpha 250 land property, (a vacant parcel located in Pompano Beach), were distributed to Broward County and the RRB Municipalities pursuant to a settlement agreement between Broward County and the RRB Municipalities.  As part of the Settlement Agreement, the Alpha 250 Site was to be sold.  However, Broward County and the RRB Municipalities agreed to delay the sale in order to allow the cities and Broward County to explore options for various solid waste and recycling issues, including the potential use of the Alpha 250 site.

 

3. A Solid Waste Working Group consisting of three municipal city administrators and three county administrators created a scope of work for a solid waste and recycling issues study.  The study was to evaluate and provide recommendations regarding the following:

 

A)                     How a 75 percent County-wide recycling goal may be reached.

B)                     Whether retaining public ownership of Alpha 250 would facilitate the meeting of that recycling goal or would provide other benefits in connection with solid waste disposal within Broward County.

C)                     General solid waste disposal issues which may include options regarding flow control and potential governance or contractual structures for collaborative management of solid waste disposal.

 

4. A solicitation for the study was issued in March 2017.  Arcadis, U.S., Kessler Consulting, Total Municipal Solutions, and GMAC Consulting, collectively, referred to as the Arcadis Team, was selected in June 2017.  The Solid Waste and Recycling Issues Study Final Report, attached hereto as Exhibit "B", was completed in December 2018. 

 

 

5. The Arcadis Team findings and recommendations include the following:

A)                     An evaluation of three different scenarios where the 75% recycling goal could be met by 2025.

B)                     The Alpha 250 property should be retained as a viable location for a solid waste processing facility.

C)                     An independent special district be created as the governance structure for any established regional solid waste management system.

D)                     The solid waste processing facilities developed as part of the regional solid waste management system be based on public/private partnership ownership.

 

6. After the issuance of the Arcadis Team Final Report, the County and representatives of the RRB municipalities developed a Memorandum of Understanding (MOU) in order to establish the interest of the County and all municipalities in Broward County in continuing to explore the feasibility of the Arcadis recommendations and other issues relating to the future of solid waste disposal and recycling processing in Broward County (See attached, Exhibit C- 2019-05-24 Solid Waste MOU Final).  Interested parties would include municipalities like Pembroke Pines who were not part of the RRB. 

 

7. The MOU's intent is to identify the local governments that wish to participate in continuing review of the Arcadis recommendations and issues relating to the future of solid waste disposal and recycling processing in Broward County. The MOU is intended to permit both the RRB and non-RRB municipalities to confirm their interest in participating in the process.  It provides a critical path on the process, including a schedule for the establishment of a regional solid waste management system. Each participant will have representation and agree to work with one another to develop county-wide strategies and solutions.  A working group made up of participating elected officials will be formed to establish policy and provide direction.

 

8. The MOU does not bind any participating municipality to commit to a short or long-term solution, or to any future agreement or action. It does not require any changes in the present solid waste and recycling processing arrangements of any of the parties. Any party to the MOU, including the City of Pembroke Pines, can withdraw from the MOU at any time by serving written notice to the other parties of the MOU.

 

9. Request City Commission to approve and authorize the proper city officials of the City of Pembroke Pines to execute the Memorandum of Understanding with Broward County and other participating municipalities regarding collaborative study and subsequent development of an integrated solid waste and recycling system, attached hereto as Exhibit "A" and incorporated herein; providing for conflicts; providing for severability; and providing an effective date.
