MOTION TO RATIFY THE CITY MANAGER’S APPROVAL FOR THE EMERGENCY SOLE SOURCE REPAIR OF ONE OF THE EAST BLOWERS LOCATED AT THE CITY’S WASTEWATER TREATMENT PLANT WITH ATLAS COPCO COMPRESSORS, LLC FOR A TOTAL AMOUNT NOT TO EXCEED $43,215 PURSUANT TO SECTION 35.18(C)(1) OF THE CITY'S CODE OF ORDINANCES.

SUMMARY EXPLANATION AND BACKGROUND:
1. The City Wastewater Treatment Plant facilitates treatment of sewage using air blowers.
2. In February 2019, the Wastewater Treatment Plant experienced several air blower failures which placed the Wastewater Treatment Plant at risk of losing treatment.
3. At the time of the air blower failures, the Utility Division approved Jacobs to proceed with the repair of one of the East Blowers as an emergency sole source repair with the intent to reimburse Jacobs utilizing the City’s Maintenance and Repair (M&R) account as provided for in the Contract with Jacobs.
4. Rather than a reimbursable to the Jacobs M&R account, paying this through the City saved the City a total cost of $3,025.05 in taxes.
5. On October 2, 2019, the City Manager approved the emergency sole source repair of this blower for a total amount of $43,215.
6. Pursuant to Section 35.18(C)(1) of the City’s Procurement Code; “In urgent cases of compelling emergency that require the immediate purchase of commodities or services, the City Manager is empowered to waive the competitive bidding or competitive proposals and authorize the Chief Procurement Officer to secure by open market procedure any commodities or services, notwithstanding the estimated cost of the commodities or services.”
7. Attached to this agenda is a sole source letter from Atlas Copco Compressors, LLC stating, “Atlas Copco Compressors, LLC is a factory direct service provider in Florida for Atlas Copco compressed air Oil Free Compressors ZR-ZT-ZA-ZH, VSD, Oil Flooded Compressors G-GA-GR-GX, Air Dryers FD-CD-BD-MD and HSBT Turbo Blowers....
