PROPOSED ORDINANCE 2019-22 IS AN ORDINANCE OF THE CITY OF PEMBROKE PINES, FLORIDA, AMENDING TITLE IX, “GENERAL REGULATIONS,” CHAPTER 91, “ANIMALS,” BY SPECIFICALLY CREATING SECTION 91.20, “WILD AND EXOTIC ANIMALS,” PROVIDING FOR DEFINITIONS; PROVIDING FOR THE PROTECTION OF WILD AND EXOTIC ANIMALS IN TRAVELING ACTS FOR PUBLIC ENTERTAINMENT OR AMUSEMENT WITHIN THE CITY OF PEMBROKE PINES; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE.

 

Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

 

This item Proposed Ordinance 2019-22 was deferred at the December 4, 2019 Commission Meeting.  It will be read as First Reading Proposed Ordinance 2019-22 at the January 15, 2020 Commission Meeting.

 

1. Commissioner Castillo presented an agenda item (reference 19-1314) requesting discussion and possible action for the creation of an ordinance to prohibit the use of instruments that cause unjustifiable pain or suffering to a wild or exotic animal being displayed within the City boundaries.

 

2. Members of the public spoke in support of the creation of an ordinance to protect wild or exotic animals from these instruments.

 

3. Zoos, scientists, and trainers have begun to condemn the use of these instruments in favor of more humane handling and training methods.

 

4. Similar ordinances have been passed by other municipalities and the Commission item specifically referenced the City of Sebring's ordinance.

 

5. The City Commission, at the November 13, 2019 meeting voted to create an ordinance to protect wild and exotic animals from instruments that may cause unjustifiable pain or suffering including but not limited to bullhooks, electrical prods or whips for the purpose of controlling or training the behavior of the animal.

 

6. At the December 4, 2019 meeting, the City Commission requested a review of new federal law regarding animal abuse. The City Attorney memo has been attached to this message.

 

7. Motion to pass proposed ordinance no. 2019-22 on first reading.

 

8. Second and final reading has been tentatively scheduled for February 19, 2020.
