MOTION TO APPROVE THE PURCHASE OF A CATERPILLAR DP30N DIESEL PNEUMATIC TIRE LIFT TRUCK FROM KELLY TRACTOR CO. FOR A TOTAL COST NOT TO EXCEED $44,600 UTILIZING THE FLORIDA SHERIFFS ASSOCIATION’S (FSA) CONTRACT NUMBER: FSA18-VEH16.0 SPEC. #71 PURSUANT TO SECTION 35.18(C)(5) OF THE CITY'S CODE OF ORDINANCES.

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is regarding "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states, "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(5) states, “Commodities or services that are the subject of contracts with the state its political subdivisions or other governmental entities including the United States Government, are exempt from the competitive procurement process.”

 

- Section 35.25(A) states, "A purchase of, or contract for, commodities that is estimated by the Chief Procurement Officer to cost $5,000 or less, may be purchased either in the open market without newspaper advertisement and without observing the procedures prescribed by Section 35.19, or in accordance with the competitive bidding procedure prescribed by Section 35.19, as deemed appropriate by the Chief Procurement Officer."

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

- The City is utilizing FSA bid # FSA18-VEH16.0 to complete this purchase. FSA attempts to include scheduled, factory and aftermarket options in the bid document. If a purchaser requests a non-scheduled option that is not included in the bid document, the vendor may provide this nonscheduled option. The purchaser has the opportunity to request the vendor’s discount pricing for any nonscheduled options during the quote process.

 

 

SUMMARY EXPLANATION AND BACKGROUND:

1.  The Utilities Division is requesting to purchase a Caterpillar DP30N Diesel Pneumatic Tire Lift Truck from Kelly Tractor Co. utilizing the Florida Sheriffs Association’s (FSA) Bid # FSA16-VEH16.0.

 

2.  The Caterpillar DP30N Diesel Pneumatic Tire Lift Truck is a new piece of equipment which will be utilized outdoors at the Utilities Operations Center for the unloading of materials off of trucks at the facility.

 

3.  Kelly Tractor Co. has provided a quote for the Caterpillar DP30N Diesel Pneumatic Tire Lift Truck at a total cost of $44,600, which includes a $7,255 discount off of the non-scheduled options.

 

4.  The quote provided by Kelly Tractor Co. includes item # 65k-FPS-B161 Side-Shifting Fork Positioner for $2,400, which is not included on the Florida Sheriff's Association Contract.  As the item is from another manufacturer, it does not receive the contract discount.  Pursuant to Section 35.25(A) of the City's Code of Ordinances, these items are being purchased by the open market procedure.

 

5.  Request City Commission to approve the purchase of a Caterpillar DP30N Diesel Pneumatic Tire Lift Truck from Kelly Tractor Co. for a total cost not to exceed $44,600 utilizing the Florida Sheriffs Association’s (FSA) Contract Number: FSA18-VEH16.0 SPEC. #71 pursuant to Section 35.18(C)(5) of the City’s Code of Ordinances.
