Summary Explanation and Background

SUMMARY EXPLANATION AND BACKGROUND:
1. The Agreement is intended to reimburse the City for its costs of enforcing the County’s Emergency Orders regarding COVID-19.

2. The term of the Agreement is from June 1, 2020, through February 28, 2021.

3. The Enforcement Period is From June 1, 2020 to December 31, 2020. The City will receive seven equal payments of $40,000.00 per month, for a total of $280,000.00, for the enforcement period. The remaining term is apparently for tracking complaints that may have been received prior to December 31, 2020. The City will receive no additional compensation for January and February, 2021.

4. Under the Agreement, the City will be required to enforce the County’s Emergency Orders relating to COVID-19 during the Enforcement Period. This would include warnings, notices of violation and if necessary conduct hearings. Note that the City has been working with state and county officials on enforcement of state and county orders since the initial state of emergency was declared in March.

5. The County Attorney has confirmed that the City maintains all discretion on how to address alleged violations.

6. During the Enforcement Period, the City will need to respond to all complaints within 24-48 hours of receiving the complaint.

7. The City will need to enter all complaints and how they were addressed in the County’s database.
