MOTION TO APPROVE THE PURCHASE FROM NEARPOD, INC. ACCESS TO THE NEARPOD DIGITAL INSTRUCTIONAL PLATFORM AND FLOCABULARY LITERACY PROGRAM THROUGH SOFTWARE LICENSES IN THE AMOUNT NOT TO EXCEED $44,501.59 FOR THE 2020-2021 SCHOOL YEAR, PURSUANT TO SECTIONS 35.18(C)(7)(H) and 35.18(C)(7)(I) OF THE CITY'S CODE OF ORDINANCES.

PROCUREMENT PROCESS TAKEN:
- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”
- Section 35.18 of the City's Code of Ordinances is regarding "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."
- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"
- Section 35.18(C)(7) states that "The following contractual services are not subject to the competitive procurement requirement:"
- Section 35.18(C)(7)(h) states that "Copyrighted materials, including computer software;"
- Section 35.18(C)(7)(i) states that "Software licensing and maintenance with the company from which the software was purchased, or its authorized representative;"
- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."
- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval."
- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."
SUMMARY EXPLANATION AND BACKGROUND:
1. Nearpod, Inc. is an ed-tech company that offers ready-to-run K-12 instructional lessons, through a digital instructional platform that merges formative assessment and dynamic media for collaborative learning experiences. Nearpod ed-tech resources are aimed at helping students, educators, and school districts achieve academic success in their distance learning and blended learning programs and can be used to supplement school curriculum.
2. Nearpod, Inc. also offers Flocabulary, a learning program that engages students and increases achievement through educational music videos while promoting literacy for grades K-12. Flocabulary digital content includes course curriculum in math, vocabulary, language arts, social studies, science, as well as life skills subject areas.
3. Nearpod’s digital instructional learning content can be integrated into the Pembroke Pines Charter Schools (PPCS) current CANVAS learning management platform which helps charter school educators centralize course curriculum and online instructional materials. Additionally, because the content is easily incorporated into CANVAS, students can use their existing login credentials.
4. Due to the COVID-19 pandemic, school administration re-evaluated their software needs and determined that expanding their use of Nearpod software products would be beneficial for student achievement through the PPCS distance learning program. Specifically, the PPCS would like to utilize Nearpod’s digital learning platform through the purchase of a charter school systemwide software license and the PPCS Elementary, Middle and FSU Elementary schools would like to utilize Nearpod’s Flocabulary program through the purchase of site software licenses for the 2020-2021 school year.
5. The cost to access Nearpod’s digital learning and Flocabulary program is listed below (See Exhibit 1. FY2020-21 Nearpod/Flocabulary quotes).

6.
