MOTION TO APPROVE THE AMENDED MASTER AGREEMENT WITH GLOBAL BUSINESS SOLUTIONS, INC., TO INCLUDE THE PURCHASE OF TESTING VOUCHERS IN AN AMOUNT NOT TO EXCEED $13,560, AND AMEND THE AGREEMENT TO AN ANNUAL AMOUNT NOT TO EXCEED $90,722 PURSUANT TO SECTION 35.28(B) OF THE CITY’S CODE OF ORDINANCES.

 

Summary Explanation and Background

 

PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.28 of the City's Code of Ordinances is titled "CHANGE ORDERS."

 

- Section 35.28(B) states that "Notwithstanding the provisions of (A) above, the City Manager is not authorized to approve a change order without authorization of the City Commission where the initial purchase required the City Commission's approval and where the sum of all change orders issued under the contract exceeds 5% of the original contract amount or $25,000.

 

SUMMARY EXPLANATION AND BACKGROUND:

 

1. The Florida Career and Professional Education Act was created to provide a statewide planning partnership between business and education communities, to expand and retain high-value industry, and sustain a vibrant state economy (See Exhibit #1- Section 1003.491-Florida Career and Professional Education Act).

 

2.  In school year 2019-2020, the Academic Village Charter School (AVCS), in partnership with Global Business Solutions Inc. (GBSI), established a cybersecurity program where AVCS students can enroll in courses that provide curriculum and resources specific to the Florida Department of Education Cybersecurity Framework and accordance with the Florida Career and Professional Education Act. Students that participate in the AVCS Cybersecurity Program can test for industry certification.

 

3. On June 19, 2019, City Commission approved the purchase of a cybersecurity curriculum package, professional development, software licenses, computer hardware, and textbooks from GBSI for a total amount of $77,162 (See Exhibit 2. GBSI Commission Approval 2019-2020).

 

4. Not included in the 2019-2020 GBSI purchase were testing vouchers.  AVCS students that participate in the cybersecurity program need the testing vouchers in order to take the industry certification exams after completion of the program. Each testing voucher costs $226 each, and the AVCS is projecting that they will need 60 testing vouchers for a total amount of $13,560 (See Exhibit 3.  GBSI Cybersecurity Master Agreement with 1st Amendment and Quote).

 

5. The testing voucher purchase would exceed the $77,162 commission approved amount by $13,560, a 17.57%. The current agreement with GBSI was amended to include the purchase of the testing vouchers (See Exhibit 3.  GBSI Cybersecurity Master Agreement with 1st Amendment and Quote).

 

6. Request City Commission approve the amended master agreement with Global Business Solutions, Inc. to include the purchase of testing vouchers in an amount not to exceed $13,560, and amend the agreement to an annual amount not to exceed $90,722, pursuant to Section 35.28(B) of the City's Code of Ordinances.
