Summary Explanation and Background

 

SUMMARY EXPLANATION AND BACKGROUND:

 

This item is being brought back for administrative purposes relating to noticing.  After adoption on January 13, 2021, staff discovered the display ad was not published by the newspaper as required by State Statutes.   No other changes have been made with the exception of two policies within the Infrastructure Adoption element that specifies the new date of adoption (February 3, 2021).

 

1.  The City of Pembroke Pines is submitting a regular scale land use plan amendment application for the update of the Water Supply Facilities Work plan.  The work plan is required to be adopted within 18 months after the South Florida Water Management District (SFWMD) updates the regional water supply plan.  The SFWMD updated the Lower East Coast Regional Water Supply Plan in November 2018, therefore the City is required to adopt the updates and amendments by May 2020.  Nonetheless, due to COVID -19, the SFWMD acknowledged the delays in adoption and confirmed no penalties will be imposed. 

 

2.  The updates include text amendments to the Future Land Use, Infrastructure, and Conservation Elements and the City's 10-Year Water Supply Facilities Work Plan which was adopted by the City Commission in 2015 (Ordinance No. 1813- see Exhibits 2, 3 and 4 and 5).

 

3.  The work plan must project the City's water use needs for at least a 10-year period; identify and prioritize the water supply facilities and sources of water that will be needed to meet the demand; and include in the City's Five-Year Schedule of Capital Improvements a financing schedule to fund the necessary capital improvements identified in the work plan.  Attached as Exhibit 9 is a copy of the City of Pembroke Pines, Florida 10 Year Water Supply Facilities Work Plan (WSFWP) dated June 3, 2020, prepared by the City's Utilities Division consultant, Calvin-Giordano and Associates.

 

4.  The City's proposed WSFWP projects water use needs for a 10 year period.  The City is not proposing any Alternative Water Supply (AWS) projects since no shortages in supply are projected for the 10 year planning period. 

 

5.  Sections 163.3177 and 373.709, State Statutes, also require updates to the following Comprehensive Plan Elements goals, objectives and policies section:

 

                     a.  Future Land Use Adoption Element

                     b.  Infrastructure Adoption Element (Potable Water Supply Subsection); and

                     c.  Conservation Adoption Element

 

6.  No changes to the policies within the Intergovernmental Coordination or Capital Improvements Elements were needed.  Exhibit 6 is a list of revisions to the above Elements.  The proposed amendments are consistent with Sections 163.3177 and 373.709, State Statutes.

 

7.  At the public hearing and meeting of the Planning and Zoning Board sitting as the Local Planning Agency on March 12, 2020, passed a motion to transmit the proposed amendments and WSFWP to the City Commission and the State of Florida Department of Economic Opportunity with a positive recommendation.

 

8. On 6/17/2020, the City Commission passed proposed Ordinance No. 2020-06 on first reading, transmitting the amendment to the Florida Department of Economic Opportunity and other review agencies with a favorable recommendation.

 

9.  The only comments received by City staff were from the South Florida Water Management District on November 13, 2020 (Exhibit 8).  The City's consultant responded to the comments and participated in virtual meetings with staff and SFWMD (Exhibit 8).

 

10.  Updates were made to the goals, objectives, and policies sections of the Infrastructure and Conservation adoption elements as well to the WSFWP to address all comments.  The updates are attached and the list of changes has been amended.

 

11.  Recommend adopting Proposed Ordinance No. 2020-06.
