- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(3) states that "City standard, single-source and sole- source commodities or services.  City standard, single-source and sole-source commodities or services are exempt from this section."

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval."

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

1.  The City owns and operates their Wastewater Treatment Plant located at 13955 Pembroke Road.

 

2.  The first level of filtration used at the Wastewater Treatment Plant is a bar screen filter system designed to remove objects such as rags, wipes, plastics and metals from wastewater to prevent damage and clogging of downstream equipment, piping, and appurtenances. 

 

3.  The existing bar screens have reached their useful life and there has been several failures of the existing bar screen equipment with associated repair costs.

 

4.  Failure of the bar screens will result in buildup of rags, wipes, plastics and metals, resulting in a clog of downstream equipment and possible sewage spills.

 

5.  It is imperative that the City purchase back-up bar screens in place as a contingency plan for further failure or if one of the existing bar screens is to reach failure.

 

6.  The City Utilities Division desires to utilize Aqua Guard Self-Cleaning Bar/Filter Screens as the City Standard due to the reliability, longevity and low maintenance costs.  In addition, two Aqua Guard Self Cleaning Bar/Filter Screens were originally designed and installed at the Wastewater Treatment Plant and provided over 20-years of reliable service.  Other bar/filter screen manufacturers on the marker have been utilized in the past with higher maintenance costs and are thus not desirable.

 

7.  Parkson Corporation has provided a sole source letter stating that, “Parkson Corporation is the sole provider for the Aqua Guard Element screen. Parkson Corporation is the original manufacturer/supplier of the subject product and is the only source for OEM replacement parts.”

 

8.  Parkson Corporation, the sole source provider for Aqua Guard Element Bar Screens has provided a quote for the purchase of two (2) Aqua Guard Self Cleaning Bar/Filter Screens Model AG-MN-A for an amount not to exceed $220,000.

 

9.  Request City Commission to approve the Aqua Guard Self-Cleaning Bar/Filter Screens as the City’s Standard Bar Screen for the Wastewater Treatment Plant and to approve the purchase of two (2) Aqua Guard Self Cleaning Bar/Filter Screens Model AG-MN-A from the Sole Source Provider Parkson Corporation in an amount not to exceed $220,000, pursuant to Section 35.18(C)(3) of the City’s Code of Ordinances.
