MOTION TO APPROVE THE DEPARTMENT RECOMMENDATIONS FOR THE FOLLOWING ITEMS LISTED ON THE CONTRACTS DATABASE REPORT:
(A) North America Fire Equipment Co., Inc. d/b/a NAFECO - Fire Department Uniforms - Renewal
ITEMS (B), (C) and (D) WILL NOT BE RENEWED, THEREFORE, NO COMMISSION ACTION IS REQUIRED AS THESE ARE PRESENTED FOR NOTIFICATION PURPOSES ONLY PURSUANT TO SECTION 35.29 (F) OF THE CITY’S PROCUREMENT CODE:

(C) Ferguson Enterprises, LLC - Backflows and Water Meter Parts & Lift Station Rehab Materials - Non-Renewal
(D) Fortiline, Inc. - Backflows and Water Meter Parts & Lift Station Rehab Materials IFB # PSUT-19-02 - Non-Renewal
Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:
1. Pursuant to Section 35.29(F) "City Commission notification" of the City's Code of Ordinances, "The City Manager, or his or her designee, shall notify the Commission, in writing, at least three months in advance of the expiration, renewal, automatic renewal or extension date, and shall provide a copy of the contract or agreement and a vendor performance report card for the contract or agreement to the City Commission."
2. On May 17, 2017, Commission approved the motion to place all contracts from the Contract Database Reports on consent agendas as they come up for contractual term renewal so that City Commission affirms directions to administration whether to renew or to go out to bid.
3. The Agreements shown below are listed on the Contracts Database Report for renewal.
(A) North America Fire Equipment Co., Inc. d/b/a NAFECO - Fire Department Uniforms - Renewal
1. On August 4, 2021, the City entered into an Agreement with North America Fire Equipment Co., Inc. d/b/a NAFECO for a six (6) month period, commencing August 4, 2021 and expiring January 28, 2022.
2. North America Fire Equipment Co., Inc. D/B/A NAFECO provides uniforms to the City’s Fire Department.
3. Section 4.1 of the Original Agreement authorizes the Parties to renew the Original Agreement for two (2) additional, one (1) year renewal terms as permitted by Exhibit "1 ", and pursuant to a written amendment to the Original Agreement, based on renewal by Sarasota County of their Agreement with NAFECO.
4. On August 4, 2021 Sarasota County expressed its desire to renew their agreement with NAFECO and on August 10, 2021 NAFECO agreed to the renewal. Their renewal agreement has been signed by NAFECO and the fully executed document will soon become available.
5. The Fire Department is satisfied with the performance and execution of the Original Agreement and recommends that the City Commission approve this First Amendment for the one (1) year renewal term commencing on January 29, 2022 and ending January 28, 2023, as allowed by the Agreement.

(B) Certiport-NCS Pearson-Microsoft Training and Certification (Non-Renewal)
1. Certiport is the sole provider and exam developer for the Microsoft Office Specialist (MOS) and the Adobe Certified Association (ACA) industry certification programs.
2. On October 3, 2018, the City entered into a Contractual Services Agreement with Certiport, a service mark of NCS Pearson, Inc. for an initial one (1) year period which naturally expired on October 2, 2019.
3. Section 3.2 of the Original Agreement authorized the renewal of the Original Agreement for two (2) additional one (1) year renewal terms upon mutual consent, evidenced by a written Amendment.
4. On October 3, 2019, the Parties executed the First Amendment to the Original Agreement for the first one (1) year renewal period which naturally expired on October 2, 2020.
5. On June 17, 2020, the Parties executed the Second Amendment to the Original Agreement, as amended, for the second and final, one (1) year renewal term which naturally expires on October 2, 2021.
6. The Original Agreement, as amended, does not allow for any further renewals. The City’s Charter Schools will be presenting the new Agreement to City Commission.
(C) Ferguson Enterprises, LLC - Backflows and Water Meter Parts & Lift Station Rehab Materials - Non-Renewal
1. On February 5, 2020, the City entered into a Continuing Purchase Agreement with Ferguson Enterprises, LLC for an initial two (2) year period, commencing on February 5, 2020 and expiring on February 4, 2022.
2. The City of Pembroke Pines Police Department utilizes Ferguson Enterprises, LLC to provide backflow protection assemblies, residential dual check assemblies, water meter boxes and lids, water meter assemblies, appurtenances and lift station rehab materials to the Utilities Department.
3. Section 3.2 of the Original Agreement authorizes the renewal of the Original Agreement for additional one (1) year renewal terms upon mutual written consent, evidenced by a written Amendment.
4. Ferguson Enterprises, LLC does not wish to renew this Agreement.
5. The Utilities Department is beginning a new procurement process for the provision of these items.
(D) Fortiline, Inc. - Backflows and Water Meter Parts & Lift Station Rehab Materials IFB # PSUT-19-02 - Non-Renewal
1. On February 5th, 2020, the City entered into a Continuing Purchase Agreement with Fortiline, Inc. for an initial two (2) year period which expires on February 4th, 2022.
2. Fortiline, Inc. provides the City with the requested backflow protection assemblies, residential dual check assemblies, water meter boxes and lids, water meter assemblies, appurtenance and Lift Station Rehab materials.
3. Section 3.2 of the Original Agreement authorized the renewal of the Original Agreement for three (3) additional two (2) year terms upon mutual consent, evidenced by written amendments to the Original Agreement extending the term thereof.
4. Fortiline, Inc. does not wish to renew this Agreement.
5. The Utilities Department is beginning a new procurement process for the provision of these items.
