MOTION TO APPROVE THE PURCHASE AND AGREEMENT FROM THE SOLE SOURCE VENDOR, CERTIPORT, A BUSINESS OF NCS PEARSON, INC.,FOR LEARNING CURRICULUM AND ASSESSMENT TESTING MATERIALS IN THE AMOUNT OF $32,868 TO HELP SUPPORT CAREER AND TECHNICAL EDUCATION AT THE CITY OF PEMBROKE PINES CHARTER MIDDLE AND HIGH SCHOOLS FOR THE 2021-2022 SCHOOL YEAR, PURSUANT TO SECTION 35.18(C)(3) OF THE CITY’S CODE OF ORDINANCES.

 

Summary Explanation and Background

 

PROCUREMENT PROCESS TAKEN:

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(3) states that "City standard, single-source and sole- source commodities or services. City standard, single- source and sole-source commodities or services are exempt from this section."

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval."

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

1. The City of Pembroke Pines Charter School would like to broaden students’ opportunities to gain certifications that will support their continued success in areas relating to career and technical education. 

 

2. The Florida Career and Professional Education Act was created to provide a statewide planning partnership between business and education communities, to expand and retain high-value industry, and sustain a vibrant state economy (See Exhibit 1. FS 1003.491-Florida Career and Professional Education Act). Through the successful development of a Career and Technical Program within the City of Pembroke Pines Charter School System, students will take courses that meet the requirements of the Florida Career and Professional Education Act (CAPE) for the 2021-2022 school year.

 

3. Students will enroll in courses that provide curriculum specific to the Adobe® Certified Association (ACA) certification and Microsoft ® Office Specialist (MOS) certification.  These certification exams would be purchased through Certiport, a business of NCS Pearson, Inc. ("Certiport"), allowing the City of Pembroke Pines to be a designated testing center, also referenced as a CAPE Academy. The primary benefits of establishing CAPE Academies at the City of Pembroke Pines Charter Schools are:

 

        a)  All CAPE Academies are aligned to an Industry Certification on the State Funding List.  Students enrolled in CAPE Academies are more likely to attain the appropriate Industry Certification, which will positively impact   the school grade.

      b)  Students who earn an Industry Certification aligned to the CAPE Academy in which they are enrolled will generate state bonus FTE funding as well as acceleration points for school grade calculation, in accordance with the Act. The funding amount is based on the annually approved state-shared appropriations.

 

4. The cost to purchase through Certiport, the MOS assessment bundle and curriculum is $8,230 per middle school site (West, Central and Academic Village Middle Schools) and the cost to purchase the ACA assessment bundle and curriculum is $8,178 for the Academic Village High School (See Exhibit 2. Certiport Quote 2021-22).

 

5. Certiport, is the sole provider and exam developer for the Microsoft Office Specialist (MOS) and the Adobe Certified Association (ACA) industry certification programs.

 

6. On October 3, 2018, the City entered into a contractual services agreement with Certiport, for an initial (1) year term which expired on October 2, 2019.

 

7. Section 3.2 of the Original Agreement authorized the renewal of the Original Agreement for two (2) additional one (1) year renewal terms upon mutual consent, evidenced by a written Amendment.

 

8. On October 3, 2019, the Parties executed the First Amendment to the Original Agreement for the first one (1) year renewal term which naturally expired on October 2, 2020.

 

9. On June 17, 2020, the Parties executed the Second Amendment to the Original Agreement, as amended, for the second and final, one (1) year renewal term which naturally expires on October 2, 2021 (See Exhibit 3.Certiport 2018 Original Agreement and Amendments).

 

10. The term of the new agreement with Certiport, will be for a one (1) year period, and may be renewed for one (1) additional one year term (See Exhibit 4. NCS Pearson Agreement).

 

11. Request City Commission to approve the purchase and agreement from the sole source vendor, Certiport, a business of NCS Pearson, Inc., for learning curriculum and assessment testing materials in the amount of $32,868 to help support career and technical education at the City of Pembroke Pines Charter Middle and High Schools for the 2021-2022 school year.

b)   Amount budgeted for this item in Account No: $32,274 is budgeted in the 2021-2022 Adopted Charter School Budget within the 552652 Noncapital software accounts. A budget adjustment from the West Middle, Central Middle, and AVCS operating accounts will be processed and transferred to the applicable 552652 Noncapital Software & Licenses school accounts to fund the remaining $594 cost.
