MOTION TO APPROVE AN ENCROACHMENT AGREEMENT WITH WALNUT CREEK FOR INSTALLATION OF A CHAIN LINK FENCE.

SUMMARY EXPLANATION AND BACKGROUND:
1. Walnut Creek Community Development District (WCCDD) proposes to place a fence adjacent to the canal on NW 72nd Avenue and Sheridan St on public right of way (ROW).
2. There is a concern by the District for public safely as the soil/ground is not stable adjacent to the canal.
3. The fence will also serve as a construction barrier for the work the District anticipates to conduct in the future on the canal banks.
4. Central Broward Water Control District (CBWCD) has approved an Easement Agreement for this fence.
5. WCCDD would maintain the ROW area from the water’s edge to the fence and between the fence and the edge of the sidewalk.
6. This Encroachment Agreement will not exempt WCCDD from obtaining all necessary permits and approvals for this fence installation.
7. Administration is requesting City Commission approval to grant WCCDD an Encroachment Agreement for installation of this fence.
