MOTION TO ADOPT PROPOSED ORDINANCE NO. 2021-28 ON SECOND AND FINAL READING.

 PROPOSED ORDINANCE NO. 2021-28 IS AN ORDINANCE OF THE CITY OF PEMBROKE PINES, FLORIDA AMENDING APPENDIX “A” OF TITLE XV, CHAPTER 150 OF THE CITY’S CODE OF ORDINANCES BY UPDATING THE BUILDING PERMIT FEE SCHEDULE, ATTACHED HERETO AND INCORPORATED HEREIN BY REFERENCE; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.

Summary Explanation and Background

1. On June 14, 2014, the City adopted Ordinance No. 1783 which amended the City permit fee schedule.

2.  The State legislature recently amended 713.135, Florida Statutes which now requires, "An authority that issues building permits may not require an applicant to provide a direct contract or a contract between a contractor and any other lien or as a condition of the application for, or processing or issuance of, a building permit for the construction of improvements or for the alteration or repair of improvements on or to commercial property. This subsection does not apply to the construction of improvements or the alteration or repair of improvements owned or leased by the federal government, the state or any county, city, or political subdivision thereof, or other public authority..."

3.  Under the proposed amendment to Chapter 150, if the Building Official, or his/her designee, determines that the cost of construction attested to does not accurately reflect the cost of construction for the scope of work covered by the permit, he/she shall utilize the greater of the following two (2) options.

                     1. A signed certified construction costs estimate for the work contemplated under the requested permit completed by one of the following licensed professionals which includes the license or certification number of the professional making the certification:
