Summary Explanation and Background

SUMMARY EXPLANATION AND BACKGROUND:

1. The City Commission at its March 17, 2021 meeting voted to approve the Land Development Code (LDC) update to the City's Code of Ordinances via Ordinance 1963.

2. On April 21, 2021, the City Commission conducted  further review and  LDCs were approved with an effective date of April 26, 2021.

3. After a year of implementation of the updated LDC, staff have identified some updates needed to the LDCs which include address the following:

 - Scriveners / grammatical errors

 - Clarifications to existing Code sections for easier interpretation / elimination of conflicting language.

 - Additional definitions

 - Updates to the Code based on policy considerations.

4.  Attached as backup is a table providing a list of proposed changes, a strikethrough and underline version of the LDCs which shows these changes as they would appear in the final document, and a copy of Section 155.013, regarding nuisances from the previous code, that will be inserted as new Section 155.544.

5.  The City Commission passed proposed ordinance no. 2022-02 on first reading at the May 18, 2022 meeting.

6.  Administration recommends adopting proposed ordinance no. 2022-02 on second and final reading.
