MOTION TO APPROVE AN INTERLOCAL AGREEMENT FOR THE CREATION OF THE METRO TRANSPORTATION ENGINEERING & CONSTRUCTION COOPERATIVE (MTECC).
Summary Explanation and Background
SUMMARY EXPLANATION AND BACKGROUND:
1. The purpose of the Metro Transportation Engineering & Construction Cooperative (MTECC) is for the City to use MTECC for Engineering Services and MTECC would be Local Agency Program (LAP) certified through the Florida Department of Transportation (FDOT).
2. The organization was created by Municipalities to support each other through the centralized delivery of transportation projects. The City would enter into 3 party project administration agreements with MTECC and FDOT to address project costs and responsibilities.
The City would pay MTECC for these Engineering Services directly and not the Broward Metropolitan Planning Organization (MPO).
These Engineering firms prequalified by MTECC would design and oversee construction of Federalized construction projects. The MPO is not a party to the individual project administration agreements.
3. Federalized projects require the City to be LAP certified. Federalized project delivery requires significant technical resources and specialized administrative knowledge to navigate federal and state reporting requirements.
4. Using the MTECC the City buys only services necessary without the need to maintain staff.
5. Key Elements of MTECC include:
- Self-governing Board
- Self-funding by members
- Primary funding through projects awards
- Municipality member annual dues to cover overhead
- MPO will provide administrative services - to be reimbursed
- Insurance
- Legal
- Administrative
- Procurement
6. The MPO has asked if the City would like to join as a member. The entry fee is $50,000. There is a $25,000 yearly fee for all Municipalities who would like to use the service. Any other municipality who would use the service would need to join with a $50,000 entrance fee.
7. Eligibility to participate in LAP is evaluated via a certification process to determine staff resources and capabilities in transportation projects as well as assess familiarity with federally funded programs.
Attached is a draft copy of the FDOT LAP certification tool for the City. Becoming LAP certified and maintaining certification requires significant manpower with expertise. The Engineering Division could not become LAP certified without out-sourcing significantly more engineering permitting and DRC reviews or hiring several more staff. Staff estimates that the process to become LAP certified would cost between $50,000 to $100,000 and to maintain it between $15,000 to $25,000 per year.
8. There are 3 upcoming projects needing LAP certification. The Pembroke Pines Mobility Hub is scheduled to begin design this year with construction next year and is funded. The next 2 projects will be re-ranked in this year’s Complete Streets Master Plan (CSMP). The 3 projects are:
a) Pines Mobility Hub within City Center - $ 3,361,600
b) CSMP - #10 Pembroke Road from SW 145 Avenue to Flamingo Road - $6,401,897 - Bike lane addition/widening and sidewalk improvements
c) CSMP - #13 Pembroke Road from Flamingo Road to Douglas Road - $9,293,260 - Bike lane addition/widening and sidewalk improvements
9. Projects that are funded by the recently passed Infrastructure Investment and Jobs Act or other Federal-aid available for use on local roads that are not part of the State Highway system would require LAP certification.
Attached is a copy of (1) the PowerPoint presentation on the MTECC program prepared by the MPO, (2) and a copy of the draft ILA needed to be accepted by the City Commission.
Staff recommends that we join the MTECC to facilitate completion of the Mobility Hub project in the near term and the 2 projects on Pembroke Rd from SW 145th Avenue to Douglas Road in the medium term.
Financial Impact
FINANCIAL IMPACT DETAIL:
a) Initial Cost: The initial cost is $75,000, for Year 1, with $25,000 annually for the next four years of the agreement.
b) Amount budgeted for this item in Account No: 100-541-6003-531100 (Professional Services-Engineering).
c) Source of funding for difference, if not fully budgeted: Not Applicable.

FEASIBILITY REVIEW:
A feasibility review is required for the award, renewal and/or expiration of all function sourcing contracts. This analysis is to determine the financial effectiveness of function sourcing services.

b) If Yes, what is the total cost or total savings of utilizing Out-Sourcing vs. In-House Labor for this service? Based on the attached analysis, we anticipate a savings of approximately $712,377 over a five year period by out-sourcing these services in-lieu of utilizing in-house labor.
