Summary Explanation and Background

 

PROCUREMENT PROCESS TAKEN:

-  Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

-  Section 35.18 of the City's Code of Ordinances is regarding "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

-  Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(5) of the City’s Code of Ordinances, “Commodities or services that are the subject of contracts with the state its political subdivisions or other governmental entities including the United States Government, are exempt from the competitive procurement process.”

 

- Section 35.18(C)(8) states, “Best interest of the city.  Purchases of and contracts for commodities or services are exempt from this section when the City Commission declares by a simple majority affirmative vote that the process of competitive bidding and competitive proposals is not in the best interest of the city.  The City Commission shall make specific factual findings that support its determination, and such contracts may be placed on the City Commission consent agenda."

 

-  Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

-  Section 35.21(A) of the City's Code of Ordinances is titled "City Commission Approval."

 

-  Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

1.  The City’s Engineering Division intends to mill and resurface the following 3 areas: Towngate neighborhood (NW 155th Avenue from NW 12th Street to NW 15th Street and NW 12th Street to NW 15th Street from Dykes Road to NW 155th Avenue); SW 4th Street (from SW 178th Avenue west through SW 182nd Avenue through to SW 12th Street); and NW 99th Avenue (from Johnson Street to Westview Boulevard).

 

2.  On February 14, 2020, Broward County Highway Construction & Engineering Division accepted the solicitation response by Weekley Asphalt Paving, Inc. to Bid # PNC2119323B1 "Roadway, Drainage, Traffic & Miscellaneous Construction" which was issued on October 18, 2019.

 

3.  Weekley Asphalt Paving, Inc. has provided a quote for milling and resurfacing of the above mentioned areas for a total amount of $735,053.24, utilizing pricing established by Broward County bid # PNC2119323B1 "Roadway, Drainage, Traffic & Miscellaneous Construction".

4.  Pursuant to Florida Statute 255.05, a payment and performance bond is required for construction projects over $200,000.

 

5.  Broward County Highway Construction & Engineering Division Bid # PNC2119323B1 did not address the cost for payment and performance bonds, however Weekley Asphalt Paving, Inc. has a provided a total cost of $9,458.55 for the payment and performance bonds for all 3 projects, which is 1.30% of the total base project cost, which the City's Engineer has deemed fair and reasonable.

 

6.  Weekley Asphalt Paving, Inc. will complete this project within 90 calendar days.

 

7.  The Engineering Division would like to add a 10% owner's contingency to each project for a total amount of $73,505.32.

 

8.  Request City Commission to approve the agreement with Weekley Asphalt Paving, Inc. for the milling and resurfacing projects of Towngate neighborhood (NW 155 Avenue from NW 12 Street to NW 15 Street and NW 12 Street to NW 15 Street from Dykes Road to NW 155 Avenue), and SW 4 Street (from SW 178 Avenue west through SW 182 Avenue through to SW 12 Street) and of NW 99th Avenue (from Johnson Street to Westview Boulevard), utilizing pricing established by the Broward County Bid # PNC2119323B1, for a total amount not to exceed $808,558.56 which includes a 10% owner’s contingency in the amount of $73,505.32, pursuant to Section 35.18(C)(5) of the City’s Code of Ordinances.
