MOTION TO RATIFY THE CITY MANAGERS APPROVAL OF THE PROFESSIONAL SERVICES AGREEMENT BETWEEN THE SOUTH BROWARD HOSPITAL DISTRICT, D/B/A MEMORIAL HEALTHCARE SYSTEM, AND THE CITY OF PEMBROKE PINES ACADEMIC VILLAGE CHARTER HIGH SCHOOL, TO PROVIDE ATHLETIC TRAINING SERVICES IN THE AMOUNT OF $40,000, FOR SCHOOL YEAR 2022-2023, PURSUANT TO SECTION 35.18(C)(2) OF THE CITY'S CODE OF ORDINANCES.

PROCUREMENT PROCESS TAKEN:

 

- Chapter 35 of the City's Code of Ordinance is titled "PROCUREMENT PROCEDURES, PUBLIC FUNDS."

 

- Section 35.18 of the City's Code of Ordinances is titled "COMPETITIVE BIDDING OR COMPETITIVE PROPOSALS REQUIRED; EXCEPTIONS."

 

- Section 35.18(C) states that "Only the following situations are exempt from the competitive bid and competitive proposal requirements of this section:"

 

- Section 35.18(C)(2) states "Contracts for professional services involving peculiar skill, ability, experience or expertise, which are in their nature unique and not subject to competitive bidding, or competitive proposals, are exempt from this section; however, state laws, such as the Consultants' Competitive Negotiation Act of the state statutes, as may be amended from time to time to the extent applicable, shall be followed."

 

- Section 35.21 of the City's Code of Ordinances is titled "AWARD OF CONTRACT."

 

- Section 35.21(A) of the City's Code of Ordinances is titled "City Commission approval."

 

- Section 35.21(A)(1) of the City's Code of Ordinance states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

SUMMARY EXPLANATION AND BACKGROUND:

1.  The City of Pembroke Pines Academic Village Charter School (‘AVCS’) offers a robust athletic program to its charter students.  In the past, the AVCS athletic program utilized U18 Sports Medicine to provide athletic trainer services to its charter students in sports team practices and game events.

 

 

2. U18 Sports Medicine is a division of the South Broward Hospital District, d/b/a Memorial Healthcare System (‘Memorial’).  For school year 2022-2023, Memorial will provide the AVCS athletic training coverage for each sports event, as agreed upon by the AVCS and the Memorial (See Exhibit 1. Executed 2022-2023 Memorial Athletic Training Services Agreement). The agreement also provides AVCS charter parents, students, and coaches the flexibility to schedule a non-emergency sports medicine appointment with Memorial pediatric orthopedic and sports medicine physicians through their online platform, JDCH.com/Ortho. 

 

 

3. The AVCS athletic program pre-season commenced on July 25, 2022. The City Manager approved the Memorial agreement prior to commission approval because athletic training services needed to be in place at the start of pre-season, and the agreement was not yet finalized by last commission meeting date, June 15, 2022.

 

 

4. The cost for these services for school year 2022-2023 is $40,000, to be paid to Memorial in two (2) $20,000 installments in December 2022 and April 2023.

 

 

5. Request City Commission to ratify City Manager approval of the professional services agreement between the South Broward Hospital District, d/b/a Memorial Healthcare System, and the City of Pembroke Pines Academic Village Charter High School, to provide athletic training services in the amount of $40,000, for school year 2022-2023, pursuant to Section 35.18(C)(2) of the City's Code of Ordinances.
