Summary Explanation and Background

PROCUREMENT PROCESS TAKEN:

- Chapter 35 of the City’s Code of Ordinances is titled “PROCUREMENT PROCEDURES, PUBLIC FUNDS.”

 

- Section 35.18(C)(7)(a) states, "Academic program reviews, lectures or seminars by individuals, professional development programs, training, and continuing education seminars are not subject to the competitive procurement requirement."

 

- Section 35.18 (C)(7)(j) states, "Educational books, technical publications or other type trade journals are not subject to the competitive procurement requirement".

 

- Section 35.21(A)(1) states, "An initial purchase of, or contract for, commodities or services, in excess of $25,000, shall require the approval of the City Commission, regardless of whether the competitive bidding or competitive proposal procedures were followed."

 

- Section 1007.271(4) of the Florida State Statutes states, "District school boards may not refuse to enter into a dual enrollment articulation agreement with a local Florida College System institution if that Florida College System institution has the capacity to offer dual enrollment courses."

 

- Section 1007.271(6)(b) of the Florida State Statutes states, " Instructional materials used in dual enrollment courses must be the same as or comparable to those used in courses offered by the postsecondary institution with the same course prefix and number. The postsecondary institution must advise the school district of instructional materials requirements as soon as that information becomes available but no later than one term before a course is offered."

 

 

SUMMARY EXPLANATION AND BACKGROUND:

1. The Dual Enrollment Program at Broward College is an accelerated program that allows eligible public/charter schools the opportunity to earn high school and college credits at the same time.  The Pembroke Pines Academic Village Charter High School (AVCHS) has participated in this program since School Year 2001-02.

 

2. Broward College and the AVCHS are required by Section 1007.271, Florida Statutes, to enter into a Dual Enrollment Articulation Agreement which outlines how both institutions will partner to provide accelerated programs to eligible secondary Charter School students, including, but not limited to, students with disabilities (See Exhibit 1. Section 1007.271, Florida Statutes).

 

3. Dual enrollment, an articulated acceleration mechanism between the Charter School and the College, shall serve to shorten the time necessary for college-ready students to complete the requirements associated with the conferment of a degree or certificate, broaden the scope of curricular options available to students, and increase the depth of study in a student’s major area of interest by offering college credit courses to eligible secondary students, including students with disabilities.

 

4. AVCHS principals and counselors are responsible for determining student eligibility and monitoring student performance and enrollment status to avoid pitfalls that may prevent students from completing high school graduation requirements. The AVCHS shall annually assess the demand for dual enrollment and provide that information to Broward College by December 1 pursuant to Section 1007.271, Florida Statutes.

 

5. Per Section 1007.271, Florida Statutes, dual enrollment students are exempt from the payment of tuition, registration and laboratory fees as well as any other Broward College institution fees.  The AVCHS agrees that the cost of tuition, registration and laboratory fees will not be passed along to the students who take courses at Broward College campus or at the high school site.  The state’s recommended tuition rate is $71.98 per credit hour.

 

6. The AVCHS will pay Broward College’s designated textbook agent, Barnes and Noble, for the cost of instructional materials (including but not limited to textbooks, access codes, lab coats, goggles, eyewear, micro slides, dissecting kits, clickers and art kits) at the end of each fall and spring terms for the instruction of students enrolled in dual enrollment courses taught on a Broward College campus, with Broward College online or at the AVCHS location per Section 1011.62, Florida Statutes (See Exhibit 2. Section 1011.62, Florida Statutes).

 

7. On April 15, 2020, City Commission approved the renewal of the dual enrollment articulation agreement between Broward College (BC) and AVCHS (‘Parties’), commencing on August 1, 2020, and concluding on July 31, 2022 (See Exhibit 3. 20-0326 BC DE Agreement Renewal).

 

8. On April 21, 2021, the Parties executed the First Amendment to the 2020-2022 dual enrollment articulation agreement which naturally expired on July 31,2022 (See Exhibit 4. BC DE Agreement 2020-2022 & First Amendment).

 

9. The term of the new dual enrollment articulation agreement with Broward College will be for a two-year period and may be renewed for one (1) additional one year term.  All Broward College and AVCHS responsibilities and expectations are detailed within the new agreement (See Exhibit 5. 2022-2024 BC DE Agreement).

 

10. Request City Commission approve the 2022-2024 dual articulation agreement between Broward College and the Pembroke Pines Charter High School, approve the payment of dual enrollment invoices to Broward College for tuition fees in an amount not to exceed $175,000, and approve the payment of dual enrollment invoices to Barnes & Noble for instructional materials in an amount not to exceed $100,000, for the Pembroke Pines Charter High School students participating in the dual enrollment program, pursuant to Sections 1007.271(4) AND 1007.271(6)(b) of the Florida State Statutes and Sections 35.18(C)(7)(a) and 35.18(C)(7)(j) of the City's Code of Ordinances.

 

Financial Impact

FINANCIAL IMPACT DETAIL:

 

a)   Initial Cost: The AVCHS Adopted Charter School Budget will provide for dual enrollment tuition and textbook expenses each fiscal school year the dual enrollment articulation agreement is renewed. The 2022-2023 projected cost for dual enrollment tuition fee expenses is $175,000 and the projected cost for instruction materials is $100,000.
