VICE MAYOR SCHWARTZ - ITEM 1: DISCUSSION AND POSSIBLE ACTION TO AUTHORIZE AND TO DIRECT THE CITY ATTORNEY, WITH THE ASSISTANCE OF THE PROFESSIONAL STAFFS OF THE CITY ADMINISTRATION, TO PREPARE AN EMERGENCY ORDINANCE FOR LAWFUL 1ST AND 2D READING AT THE COMMISSION MEETING OF 9/7/2022 WHICH WILL REGULATE, REQUIRE AND IMPOSE UPON CERTAIN BUSINESSES AND BUSINESS OPERATIONS IN THE CITY THE OBLIGATION TO PROVIDE ON-SITE, OFF-DUTY CITY POLICE DETAILS AND/OR PRIVATE SECURITY FORCES, ALL AT THE COST AND EXPENSE OF THE BUSINESS AND/OR PROPERTY OWNERS, IN ORDER TO PROPERLY MANAGE AND TO CONTROL GATHERINGS OF PERSONS AND TO BEST PROTECT THE HEALTH, SAFETY AND WELFARE OF ALL VISITORS, PATRONS, GUESTS, CUSTOMERS AND INVITEES AT SUCH LOCATIONS WITHIN THE CITY.

SUMMARY EXPLANATION AND BACKGROUND:
1. Although the City’s professional staff had previously opined and recommended that the property owner/then applicant should include off-duty police engagement/presence, or similar periodic security assistance during certain times, and under certain described circumstances, to better protect the health, safety and welfare of the citizens and residents of the City, including guests, patrons, customers, visitors and invitees of the mall, such professional analyses were not accepted or implemented by the mall. Now, we have a tragedy affecting lives and families.
2. Based upon the foregoing, Vice Mayor Jay D. Schwartz respectfully asks his colleagues to support his motion.
